Fces for public adjusters, or other third parties, retained by <br />Borrower shall not be gaid out of the insurance proceeds and shall be the sole obligation of Borrower. If <br />the restoration or repair is not �nomicatly feasible or Lender's s�urity would be lessened, the insurance <br />proceeds shall be applie� to the sums se�cureal by this Security Iastrvment, whether or not then due, with <br />the excess, if any, paid to Bonower. Such insurance prar,eeds shall be applied in the order provided for in <br />Section 2. <br />If Bonower abandons the Property, Lencler may file, negotiate and settle any available insurance <br />claim and relate� matters. If Bonower does not respond within 30 days to a notice from Lender that the <br />insurance carrier has offered to settle a claim, then Lender may negotiate and settle the claim. The 30-day <br />period will begin when. the notice is given. In eithhar event, or if Lender acquires the Property under <br />5ection 22 ar othervvise, Borrower hereby assigas to Lender (a) Bonower's rights to any insuc�nce <br />proceeds in an amo�t not to exceed the amo�mts unpaid under the Note or this Sacurity Instrument, and <br />(b) any other of Borrower's rights (other than the right to any refund of unearned premiums paid by <br />Borrower) under all insurance �lici� coveting the ProPeri�', insofar as such rights aze applicable to the <br />coverage of the Property. Lender may use the insittance procee�s either to repair ar restore the Property ar <br />to pay amounts unpaid imder the Nate or this Se�urity Instrument, whether or not then due. <br />6. Occnpancy. Borrower sha,tt occupy, establish, �d use the Properiy as Bormwer's principal <br />residence within 60 days after the exe�,rtion of this Security Iustrument and shall continue to occupy the <br />Properiy as Borrower' s principal residence for at least one year after the date of occupancy, unless Lendet <br />otherwise agr� in writing, which consent shall not be unreasonably withheld, or unless extenuating <br />circumstances exist which are beyond Borrower' s control. <br />7. Preserval3on, Maintenance and Ptotection of the Property; Inspecbions. Bonower shHll not <br />destroy, damage or impair the Property, allow the Property to deteriorate or commit waste on the <br />Property. Whether or not Bonower is residing in the Property, Borrower shall ma.intain the Property in <br />order to prevent the Property from deteriorating or d�reasing in value due to its condition. Unl�s it is <br />determined pursuant to SECtion 5 that repair ar re.storation is not economically feasible, Borrower shall <br />gromptly repair the Property if damaged to avoid further deterioration ar damage. If insurance or <br />condemnation procceds are paid in connection with damage to, or the taking of, the Properiy, Bonower <br />shall be responsible for repairing or restoring the Property only if Lender has released proceeds for such <br />purpose.s. Lender may disburse proce�s for the repairs and restoration in a single payment or in a series of <br />progresa payments as the work is completed. If the insurance or condemnation proceeds are not sufficie� <br />to repair or restore the Property, Borrower is not relieve� of Bonower's obligation far the completion of <br />such repa.ir or restoration. <br />Lender ar its agent ma.y make reasonable entries upon and inspections of the Ptoperty. If it has <br />reasonable cause, Lender may inspe�t the interior of tbe improvements on the Property. Lender shall give <br />Borrower notice at the time of or prior to such an interior inspection specifying such reasonable cause. <br />8. Borrower's Loan Application Borrower sha.11 be in default i� during the Lo� applic�tion <br />Process, Horrower or any persons ar eatities acting at the diraction of Bozrower ar with Borrower's <br />knowledge or consent gave materially false, misleading, oz inaccurate informa�ion or statemeats to Lender <br />(or failefl to provide Lender with material information) in conne�tion with the Lo�►.
