�p�1054s9 <br />NON-UNIFORM COVENANTS. Borrower and Lender further covenant and agree as follows: <br />22. Accelerntion; Remedies. Lender shall give notice to Borrower prior to acceleration following <br />Borrower's breach of any covenant or agreement in this 5ecnrity Instrament (bnt not pritor to <br />acceleration nnder 5ecHon 1S nnless Applicable Law providea otherwise). The nol3ce shall specify: (a) <br />the defanit; (b) the action required to cnre the default; (c) a date, not less than 30 days from the date <br />the nof3ce is given to Borrower, by which the default must be cnred; �nd (� that failnre to cure the <br />defanit on or before the date spedfied in the notice may resalt �in acceleral3on of the anms secnred by <br />this S�urity Instrament and sale of the Property. The notice ahall fnrther �inform Borrower of the <br />right to reinstate after acceleration and the right to bring a conrt action to assert the non-eldstence of <br />a defanit or any other defense of Borrower to acceleration and sale. If the defanit is not cnred on or <br />before the date specifi[ed in the noHce, Lender at its option may reqwlre immed3ate payment in fall of <br />a11 sams secnred by this 5ecnrlty Instrament withont fnrther demand and may invoke the power of <br />sale and any other remedies permitted by Applicable Law. Lender shall be entitled to collect all <br />expenses incarred in pnrsning the remedies provided in this Sedion 22, inclnding, bnt not limited to, <br />reasonable attorneys' fces and costs of title evidence. <br />If the power of sale is �tnvoke�d, Trast� shall record a notice of defaalt in each connty in which <br />any part of the Property is located and shall mail copies of snch noi3ce in the manner prescrlbed by <br />Applicable Law to Bortower and to the other persons prescribexl by Applicable Law. After the 13me <br />reqnired by Applicable Law, Trnstee shall glve pnblic notice of sale to the persons and in the manner <br />prescribed by Applicable Law. Trastee, withont demand on Borrower, shall sell the Property at <br />pnblic anction to the highest bidder at the time and place and nnder the terms designated in the <br />notice of sale 3n one or more parcels and in any order Trastee determ�ines. Trnstee may postpone sale <br />of all or any parcel of the Property by pnblic annonncement at the time and place of any previonsly <br />schednled sale. Lender or its designee may pnrchase the ProperLy at any sale. <br />Upon receipt of payment of the price bid, Trusta ahall deliver to the purchaser Trnstee's dced <br />conveying the Property. The recitals in the Trastee's deed shall be prtma facie evidence of the truth <br />of the statements made therein. Trustee shall apply the proceeds of the sale in the following order: (a) <br />to all costs and ezpenses of ezerdsing the power of sale, and the sale, including the payment of the <br />Trastee's fees actnally 3ncnrred and reasonable attorneys' fces as permitted by Applfcable Law; (b) to <br />a11 snms s�nr� by this Secarity �nstrament; and (c) any egcess to the gerson or persons legally <br />entitle,�l to it <br />23. Reconveyance. Upon payment of all sums secared by ttris Security Instrument, Lender shall <br />request Tn�stee to reconvey the Property and shall surrender this Se�urity Instivment and all notes <br />evidencing debt secured by this Seeurity Instrument to Trustee. Tn�stee shall re�onvey the Property <br />without warranty to the person or persons legally entitled to i� Such person or persons shall P$Y �Y <br />recordation costs. Lender may charge such person or persons a fee for re�onveying the Property, but only <br />if the fee is paid to a third party (such as the Trustee) for services render� and the cbarging of the fee is <br />permitted under Applicable Law. <br />24. Snbstitate Trustee. Lender, at its option, may from time to time remove Trustee and appoint a <br />successor trust� to any Trustee appointed hereunder by an instrument recordad in the county in which this <br />Security Insirument is recorded Without conveyance of the Property, the successor ttvstee shall suc�ed to <br />all the title, �wer and duties conferred upon Trustee herein and by Applic�ble Law. <br />25. Reqnest for Notfces.
