PARACHIlVI and BRAD PETERS, being first sworn upon oath, depose and sta.te that: 1. Otto P.A. Frauen created the Otto P.A. Frauen Revocable Living Trust pursuant to Trust Agreement dated November 23, 1993 (the "Trust") wherein he designated himself as the initial Trustee and designated Georgena E. Frauen, Joe Parachini and Brad Peters as successor Co-Trustees of the Trust; 2. From the da.te of the creation of the Trust until October 12, 2006, Otto P.A. Frauen served as Trustee of the Trust; 3. Otto P.A. Frauen died on October 12, 2006; 4. On October 20, 2006, Georgena E. Frauen executed a Declination of Trusteeship wherein she declined to serve as successor Co-Trustee of the Trust and concurrently Joe Parachini and Brad Peters executed an Acceptance of Co-Trusteeship agreeing to serve as Co- Trustees of said Trust; 5. Pursuant to Article VIII, Paragraph C. of the Trust, the Otto P.A. Frauen Family Trust was created as a result of the death of Otto P.A. Frauen and Joe Pazachini and Brad Peters have served as Co-Trustees of said Family Trust from October 12, 2006 until July 31, 2010; 6. Joe Parachini died on July 31, 2010; 7. Pursuant to Order Approving Appointment of Successor Co-Trustee entered by the Merrick County Court at Case No. PR07-27 "In the Matter of the Otto P.A. Frauen Family Trust created Pursuant to ARTICLE VIII, Para.graph C. of the Otto P.A. Frauen Trust Agreement dated November 23, 1993" Lori J. Parachini was appointed as successor Co-Trustee to serve with Brad Peters, the remaining Co-Trustee of the Trust. On September 8, 2010, the Merrick County Court issued Amended Letters of Co-Trusteeship to Lori J. Parachini as Co-Trustee of the Trust; 8. That Affiants, Lori J. Parachini and Brad Peters, are currently serving as Co- Trustees of the Trust and the Trust grants Affiants as Co-Trustees all powers under the Nebraska Uniform Trust Code; 9. The Trust is irrevocable due to the death of the decedent, Otto P.A. Frauen; 0 N d a--+ � 0 c11 s � W ► �, 10. The Internal Revenue Service has issued a taxpayer identification number for the Otto P.A. Frauen Family Trust;
