�o��a�o�� <br />NON-UNIFORM COVEJVANTS. Borrower and Lender fiuther covenant and agree as follows: <br />17. Assignment of Ren�. Bonower unconditionally assigos and transfers to Lender all the rents and revenues <br />of the Property. Boaower autharizes Lender ar Lettder' s agents to collect the rents and revenues and hereby direds <br />each tenant of the Property to pay the rents to Lender or Lendet's agents. However, prior to Lender's notice to <br />Bonower of Borrower' s breach of any covenant or agreement in the Security Insh�ument, Borrower shall collect and <br />receive all renfs and revenues of the Praperty as lrustee for the benefit of Lender sud Borrowet. This assignment of <br />rents consfitutes an absolute assignment and not an assignment for additional sec�mty only. <br />If Lender gives notice of breach to Bonower: (a) all rents received by Borrower shall be held by Bonower as <br />truatee for benefit of Lender only, to be applied to the sums se�cured by the Security Inshvment; (b) I,ender sha11 be <br />entifled to collect and receive a11 of the rents of the Properry; and (c) each tenant of the Property shall pay all rents <br />due and unpaid w Lender or Lender's agent on Lender's written demand to the tenant <br />Bonower has not executed aay prior assignment of the rents and has not and will not perform any act tbat would <br />prevent Lender from exercising it� rights undet this paragraph 17. <br />Lender shall not be required to enter upon, take control of or maintain the Properiy before or after giving notice <br />of breach to Bonower. However, Lender or a judicially appointed receiver may do so at any time there is a breach. <br />?,ny application of rents shall not cure or waive any default or invalidate any other right or remedy of Lender. This <br />assignment of rents of the Property shall terminate when the debt secu�red by the Secwity Instrument is paid in full. <br />18. Forectosure Pr��are. If I.ender requires immerliate payment in full nnder paragraph 9, Lender may <br />invoke the power of sale and any other remedies permitted by applicable law. Lender shall be entftled to wDect <br />all egpens� incurred in pursoing the remedi� provlded in this psragraph 18, 9nclnding, bat not limited to, <br />reasonable attorneys' fees and costs of fitle evldence. <br />If the power of sale is invokai, Trustee ahall record a no�lce of defaalt in each connty in which any part of <br />the Property ia located and ahall mail copfes of sach notice in the manner prescrlbed by appllcable law to <br />Borrower and to the other pereons prescr3bed by appllcable law. After the time r�nired by appHcable law, <br />Trustee, shall give pnblic notice of sale to t6e persons and In the manner prescribed by applfcable law. Trustee, <br />witho� demand on Borrower, sha[I seD the Property at pnBlic anction to tLe Ligh�t b9dder at the time and <br />place and nnder the terms des3gnated in the notice of sale in one or more parcels and in any order Trastee <br />determines. Trastee m$y postpone sale of all or any parcel of t6e Property by pablic annonncement at the 13me <br />and place of any previonsly schednled sale. Lender or fts designee may pnrchase the Property at any sale. <br />Upon receipt of payment of the price bid, Trnstee shall deliver to the pnrchaser Tmstee's deed conveying <br />the Property. T6e recitals in the Trusta's deed ahall be prima facie evidence of the trath of the atatements <br />made therein. Trustee aLall apply the proceeds of the sale in the following order: (a) to all cos� aod eapenses <br />of egercising the power of sale, and the sale, including the payme� af the 1lvstee' a fees actually incnrred and <br />reasonable attomeys' fees as permitted by applicable law; (b) to all sums secured by this SecurHy Inshvmen� <br />and (c} any eacess to the person or persoas IegaIIy entiNed to iL <br />If the Lender's interest in tLis Secarlty Instrument is held by the 5ecretary and the Secretary reqaires <br />immediate payment in foIl nnder paragraph 9, the Secretary may invoke the nonjudicial power of sale pmvided <br />in the Single Famiiy Mortgage Foreclosare Act of 1994 ("AcN� (12 U.S.C. 3751 et se .) by reqaesl3ng a <br />foreclosare wmmissioner des�ignated nnder the Act to commence farecloanre and to seD the Properiy as provided <br />in the Act Nothing in the preceding aentence shall deprlve the Secretary of any rlghts otfierwise available to <br />a Leader nnder this paragraph 18 or applicable law. <br />19. R�onveyance. U�n payment of all sums securedby this Security Instntment, Lender sha11 request Trustee <br />to reconvey the Properiy and shall simender this Security Instrument and aII notes evidencing debt sec�sed by this <br />Security Instrument ko Ttustee. TrusYee shall reconvey the Progerty without wananty to the person or persons legallY <br />entitled to it Such person or persons shall pay any recotdation costs. Lender may charge such person or persons a <br />fee for reconveying the Property, but only if the fee is paid w a thitd party (such as the Trustee) for services rendered <br />and the charging of the fee is permitted under applicable law. <br />20.
