I 1 � � � f <br />campiies with the terms of the Note, the amounts due and pqyabie under the Note shall not <br />become due and payable, but shalf be forgiven as follows: The principai amounfi of the <br />Loan shall be reduced over the first 5 years by 1 JbOth of the original principal balance of the <br />Loan for each month the Loan is outstanding. Such monthly reductions shail take effect in <br />arrears on the same day of the month the Loan was originalfy made. The amount of the <br />toan due and payable at any time shali be determined affer deducting fihe principal <br />amount of the Loan which has been forgiven by Lender. <br />2. SUBORDINATION. This Mortgage is subject and subordinate in afl respects to the liens, <br />terms, cavenants and conditions of the First Mortgage and to all advances heretofore <br />made or which may hereaffer be made pursvant fio the First Mortgage, including all sums <br />advanced for the pu►pose of (a) protecting or further securing the lien af the First Mortgage, <br />curing defaults by Barower under the Frst Mortgage or for any other purpase expressly <br />permitted by the F�rsF Marfgage; or (bJ constructing, renovating, repairing, fumishing, <br />fixturing or equipping the Properfy. The terms and provisions of the First Mortgage are <br />paramaunt and contralling, and they supersede any other terms and provisions hereof in <br />conf4ict therewith. In fihe event of fcxeclosure or deed-in-lieu of foreclosure of the First <br />Mortgage, or if the Firsst Mortgage is assigned to the Secretary of the U.S. Department of <br />Hovsing and Urban Development, any provisions herein or ony provtsions in any other <br />coilateral agreement restricting the use of the Property or otherwise restricting Borrower's <br />ability ta sell the Property shall have no further force or effect on subsequent owners or <br />purchasers of the Property. Any pe�son, including his successars ar assigns (other than <br />Borrower or a related enfiiy of Borrower�, receiving title to the Property through a foreclosure <br />or deed-in-lieu of foreclosure of the Fi�st Mortgage, or through fihe assignment of the First <br />Martgage to the Secretory af the U.S. Deparfment of Housing and Urban Development, shall <br />receive title to the Property free and clear from such restrictions. <br />3. NOTICES. Any notice to Borrower provided for in this Mortgage shail t� given by delivering <br />it or by mailing it by first class mail unless applicable !aw requires use of Qnother method. The <br />natice shall be directed to the Praperty Address ar any other address Borrower designates <br />by notice to the Lender. <br />4. RELEASE. Upon satisfaction of alf sums secured by this Mortgage (whether by payment or <br />forgiveness), Lender shall release this Mortgage without charge to Borrower. Borrower shall <br />pay any recordation costs. <br />5. MODIHCATION OF FIRST MORTGAGE LOAN D4CUMENTS. The Lender consenfis to any <br />agreement or arrangement in which Senior Lien Hoider waives, postpones, extends, reduces <br />or modi�ies any provrsions of the First Martgage Loan Documents, including any provisions <br />requiring the payment of money. <br />lN WITNESS WHEREOF, Borrawer has executed this Morfgage. <br />Borrow .
