201104685 <br />18. Foreclosare Procednre. If Lender reqnires immediate payment in fall under paragraph 9, Lender may <br />invoke the power of sale and any other remedies permitted by applicable law. Lender shall be entitled to coIIect <br />all egpensea �lncnrred in pnrsning the rem�lies nnder this paragraph 18, inclnding, bnt not limited to, <br />reasonable attorneys' fe,es and coats of 13t1e evidence. <br />If the power of sale is invoked, Trostee sha11 record a notice of defanit 3n each county in which any part of <br />the Property is located and shall mail copies of snch nottce in the manner prescrlbexl by applicable law to <br />Borrower and to the other persons pr�cribed by applicable law. After the time requ�tred by applicable law, <br />Trast� shall give pnblic noHce of sale to the persons and �in the manner prescribed by applicable law. Trastee, <br />withont demand on Borrower, shall sell the Property at pnblic anci3on to the highest bidder at the �ime and <br />place and under the terms designated in the nof3ce of sale �in one or more parcels and �n any order Trastee <br />determ�ines. Trastee may gostpone sale of all or any parcel of the Property by pnblic annonncement at the time <br />and place of any previously scheduled sale. Lender or its designee may pnrchase the Property at any �le. <br />If the Lender's �intereat in this Secnrity Instrument is held by the Secretary and the Secretary requires <br />9mmediate payment �ln fnll nnder Paragraph 9, the Secretary may �nvoke the nonjndidal power of sale <br />provided in the Single Fam�ly Mortgage Forexlosare Act of 1994 ("Act'� (12 U.S.C. 3751 d seq.) by reqnesdng <br />a foreclosare commis�toner d�ignated nnder the Act to commence foreclosure and to sell the Property as <br />prnvided in the Ac� Nothing fn the preceding sentence ahall deprYve the Secretary of any rlghts otherw�lse <br />available to a Lender under this Paragraph 18 or applfcable law. <br />Upon receipt of payment of the price bid, Trastee shall deliver to the pnrchaser Trastee's deed conveying <br />the Properiy. The redtals �in the Trastee's dced shall be pz3ma facie evidence of the trath of the statements <br />made therein. Trastee shall apply the proceeds of the sale in the following order: (a) to all costs and egpenses of <br />egercising the power of sa1e, and the sale, �inclnding the payment of the Trastee's fees actaally incurred, not to <br />ezcced 5% of the prindpal amonnt of the note at the Nme of the declaration of <br />defanit, and reasonable attorneys' fees as permitted by law; (b) to all snms secured by this Secnrlty Instrament; <br />and (c) any egcesa to the person or persons legally entitled to f� <br />19. Reconveyance. Upon payment of all sums secured by this Security Inslrument, Lender ahall request Trustee <br />to reconvey the Properiy and shall sutrender this Security Instrument and all notes evidencing debt se�vred by this <br />Security Instrument to Trustce. Trustee shall reconvey the Property without watranty and without charge to the <br />person or persons legally entitled to i� Such person or persons shall pay any re�ordation costs. <br />20. 5nbst3tate Trastee. Lender, at its option, may from time to time remove Trustee and apponrt a succassor <br />trustee to any Trust� appointed hereunder by an instrument recorded in the couaty in which this Seaurity Instinunent <br />is recarded. Without conveyanca of the Properiy, the successor trustee shall succeed to all the title, power and d�rties <br />conferred u�n Trustee herein and by apglicable law. <br />21. Reqnest for Notices. Barrower requests that copies of the notices of default and sale be sent to Borrower's <br />address which is the Ptoperiy Address. <br />22. Riders to this Secarity Instramen� If one or more riders aze executal by Borrower and recorde� together <br />with this Se�urity Instrument, the covenants of each such rider shall be incorporated inta and shall amend and <br />supplement the covenants and ag�r�ts of this Se�urity Instrument as if the rider(s) were a part of this Security <br />Instrwment.
