Z005, filed of <br />record on MARCH 31. 2005 in the HALL COUNTY REC'rISTER OF DEED'S OF'FICE OF HALL <br />COUNTY, NEBRASKA in DOCUMENT #0200502'793, the following described properiy: <br />PARCEL #1: 3040 ROSELAWN DR <br />LOT NINE (9) IN MEADOW LANE THIRD SUBDIVISION, HALL COUNTY, NEBRASKA, <br />PARCEL #2: 823 AUSTIN AVE <br />LOT TWENTY-NINE (29), BLOCK THREE (3), LAKE DAVIS ACRES SUBDIVISION, HALL <br />COLTNTY, NEBRASKA <br />WHEREAS, such Deed of Trust does not contain a provision regarding a right to future advances to be <br />secured by such Deed of Trust; <br />WHEREAS, Borrower has requested that Lender make an a.dditional advance to be secured by <br />such existing Deed of Trust; <br />WI�REAS, Lender is willing to make an ad.ditional advance to be secured by such Deed of Trust <br />provided there sha11 have been no filings of record subsequent to the date of the recording of that Deed of <br />Trust hereinahave identified; <br />WI�REAS, Borrower and Lender hez�eby desire to atnend the existing Deed of Trust identified <br />hezeinabove to provide that it shall continue to secure the presently re,�ma�ning indebtedness and the <br />additional advance and future advances from and after the date hereivaf�er specified; <br />NOW, THEREFORE, it is agreed: <br />1. Incorporation of Future Advance Ri ts. From and after the date of the e�cecution of this <br />Deed of Trust Modification Agreement, the indebtedness secured by the Deed of Trust . <br />described hereinabove sha11 secure advances made concurrently herewith and future <br />advances in accordance with the following provision which shall herea.fter be deemed to <br />be a part o£ such Deed of Trust: <br />Future Advances. Upon request of Borrower, Lender may, at its option, make additional <br />and future advauces and readvances to Bonower. Such advances and readvances, with <br />interest thereon, shall be secured by this Deed of Trust. At no time shall the principal <br />a�ount of the indebtedness secured by this Deed of Trust, not including sums advanced <br />to proteet the security of this Deed of Trust, exceed the original principal amount stated <br />herein, or 94 569.31 whichever is greater. <br />// D� <br />9/ '�- <br />
