French, Defendant, the object and prayer of which are to ask the Court to impose a Constructive Trust upon the following real property, to wit: Lot One (1), Knox 5ubdivision, City of Grand Island, Hall County, Nebraska; and to have the Court order said Defendant to convey the property to the Plaintiffs pursuant to the Plaintiffs' right to purchase the property by construing a Lease Agreement to be that of a Purchase Agreement and to determine that the Defendant, by failing to convey the real property has been unjustly enriched and for an accounting for all monies paid by Plaintiffs to Defendant under the agreement and to have Defendant have remit to Plaintiffs all monies paid in excess of the agreed amount.
