<br />Trustee under a Deed of Trust made and entered into on or about August 27, 2008, by and between I � y
<br />LARRY T. IIAMS and DESIREE D. IIAMS, husband and wife, Trustors, and THOMAS
<br />LOC�I�R, Trustee, MOIZTGAGE ELECTRONIC 1tEGIS7CRATION SYSTEMS, INC.,
<br />Beneficiary. Said Deed of Trust was recorded on August 28, 2008 as Instrument No. 2008-07466 of
<br />the Mortgage Records of Hall County, Nebraska. Said Deed of Trust having been assigned by virtue
<br />of an Assignment dated January 31, 2011 to U.S. BANK, N.A., and which was filed for record on
<br />February 8, 2011, as Instrument No. 2011-01068 of the Mortgage Records of Hall County, Nebraska.
<br />THOMAS LOCHER, Grantor, in consideration of the sum of Ninety-One Thousand Six Hundred
<br />Sixty-Three and 35/100 Dollars ($91,663.35) and other good and valuable consideration received
<br />from U.S. BANK, NATIONAL ASSOCIATION, does hereby grant, bargain, sell, convey and
<br />confirm unto U.S. BANK, NATIONAL ASSOCIATION, (hereinafter "Grantee" where
<br />appropriate), the following-described real property in Hall County, Nebraska, to wit:
<br />LOT 8 AND 9 IN BLOCK 8, IN THE ORIGINAL TOWN OF CAIRO,
<br />HALL COiJNTY, NEBRASKA.
<br />to have and to hold the above-described premises together with all tenements, hereditaments and
<br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br />1. That LARRY T. IIAM5 and DESIREE D. IIAMS, as Trustors, failed to pay to Beneficiary
<br />payments which were contractually due, and the Grantor, at the request of the Beneficiary,
<br />elected to declare the entire unpaid principal balance, together with interest thereon at once
<br />immediately due and payable.
<br />2. That Larry T. Iiams & Desiree D. Iiams filed their Chapter 13 Bankruptcy Petition on March
<br />2, 2010 and U.S. Bank, N.A. obtained relief from the Bankruptcy Stay on December 22,
<br />2010. A copy of said Order is attached hereto and marked as Eachibit "A".
<br />3. That a Notice of Default as required by § 76-1006 was filed by Grantor on February 23,
<br />2011, as Instrument No. 2011-01444 in the Office of the Register of Deeds of Hall County,
<br />Nebraska. A copy of said Notice of Default was thereafter mailed to all parties entitled to
<br />notice, pursuant to said Deed of Trust and in compliance with § 76-1008, R.R.S. Nebraska.
<br />4. That the Trustors failed to cure the default referenced in the Notice of Default within 30 days
<br />after filing of the Notice of Default.
<br />5. That a Notice of Trustee's Sale was filed by Grantor on April 4, 2011, as Instrument No.
<br />2011-02573 in the Office of the Register of Deeds of Hall County, Nebraska. A copy of said
<br />Notice of the time and place of the sale was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with § 76-1008, R.R.S. Nebraska.
<br />6. That Grantor as required by § 76-1007 published a Notice of Trustee's Sale to be held on
<br />May 25, 2011, at 10:00 a.m. in the lower lobby of the Hall County Courthouse, 111 West
<br />First Street, Grand Island, Nebraska. Said Notice was published in Grand Island Independent,
<br />a legal newspaper of Hall County, Nebraska, once a week for five consecutive weeks
<br />commencing on Apri16, 2011, and ending May 4, 2011. The last publication notice was at
<br />least ten days prior to the Trustee's Sale scheduled for May 25, 2011 and said sale was not
<br />later than 30 days after the last publication of notice. ��
