<br />DEED OF TRUST
<br />This DEED OF TRUST is made as of the 3rd day of June, 2011, by and among RICHARD OSBORNE and
<br />RUTH OSBORNE, Husband and Wife, whose mailing address for purposes of this Deed of Trust is 3010 South
<br />Blaine Street, Grand Island, NE 68801, having retained a life estate in the real estate hereafter described; and the
<br />grantees of the remainder interest in the real estate hereafter described, KATHRYN RAE OSBORNE, a single
<br />person, whose mailing address for purposes of this Deed of Trust is 3721 Faullmer Drive #209, Lincoln, NE 68516,
<br />and EMILY ANN OSBORNE MILLER, together with her spouse, ALEX D. MILLER, whose mailing address for
<br />purposes of this Deed of Trust is 216 Ingalls Street, Apt. #1, Grand Island, NE 68803-5752, (herein, "Trustor",
<br />whether one or more); the Trustee, EQUITABLE BANK (Grand Island Region), whose mailing address is 113-115
<br />N Locust 5treet, PO Box 160, Grand Island, NE 68802-0160 (herein "Trustee"); and the Beneficiary, EQUITABLE
<br />BANK, whose mailing address is Diers Avenue Branch, PO Box 160, Grand Island, NE 68802-0160 (herein
<br />"Lender").
<br />FOR VALUABLE CON5IDERATION, including Lender's extension of credit identified herein to
<br />RICHARD OSBORNE and RUTH OSBOIZNE (herein "Bonower", whether one or more), and the trust herein
<br />created, the receipt of which is hereby acknowledged, Trustor hereby irrevocably grants, transfers, conveys, and
<br />assigns to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of the Lender, under and sub-
<br />ject to the terms and conditions hereinafter set forth, the following real estate, legally described as:
<br />A tract of land comprising a part of Lot Nine (9), of Riverside Farm Subdivision in the city of
<br />Grand Island, Hall County, Nebraska a part of Section Twenty-Nine (29), Township Eleven (11)
<br />North, Range Nine (9) West of the 6�` P.M., in Hall County, Nebraska: Commencing at a point on
<br />the west line of said Lot Nine (9), said point being Two Hundred Thirteen and Two Tenths (213.2)
<br />feet south of the northwest corner of said Lot Nine (9); thence southerly along the west line of said
<br />Lot Nine (9), a distance of One Hundred Eighteen and Five Tenths (118.5) feet; thence deflecting
<br />left 95° 27' 06" and running northeasterly, a distance of Two Hundred Fifty-One and Seven
<br />Tenths (251.7) feet to the centerline of Blaine Street; thence deflecting left 123° 39' 48" and
<br />running northwesterly along the centerline of said Blaine Street, a distance of One Hundred Fifty-
<br />Six and Five Tenths (156.5) feet; thence deflecting left 60° 56' 07" and running southwesterly, a
<br />distance of One Hundred Fifty-Four and Eleven Hundredths (154.11) feet to the place of
<br />beginning and containing .58 acres more or less, subject to Thirty-Three (33.0) feet of road right-
<br />of-way on said Blaine Street; and
<br />A tract of land comprising a part of Lot Nine (9), Riverside Farm Subdivision in the city of Grand
<br />Island, Hall County, Nebraska to be more particularly described as follows: Beginning at a point
<br />on the west line of said Lot Nine (9), said point being Two Hundred Eleven and Twenty-Three
<br />Hundredths (211.23) feet south of the northwest corner of said Lot Nine (9); thence southerly
<br />along the west line of said Lot Nine (9), a distance of One and Ninety-Seven Hundredths (1.97)
<br />feet; thence deflecting left 100° 03' O1" and running northeasterly, a distance of One Hundred
<br />Fifty-Four and Eleven Hundredths (154.11) feet to the centerline of Blaine Street; thence
<br />deflecting left 119° 03' S3" and running northwesterly along the centerline of Blaine Street, a
<br />distance of Ten and Fifty-Five Hundredths (10.55) feet; thence deflecting left 63° 45' 06" and
<br />running southwesterly, a distance of One Hundred Forty-Eight and Eighty-Three Hundredths
<br />(148.83) feet to the place of beginning and containing 0.02 acres more or less, subject to Thirly-
<br />Three (33.0) feet of road right-of-way on said Blaine Street,
<br />commonly known as 3010 S. Blaine, Grand Island, NE 68801; together with all buildings, improvements, fixtures,
<br />streets, alleys, passageways, easements, rights, privileges, and appurtenances located thereon or in anywise
<br />pertaining thereto, and the rents, issues and profits, reversions and remainders thereof, and such personal property
<br />that is attached to the improvements so as to constitute a fixture, including but not limited to heating and cooling
<br />equipment, and together with the homestead or marital interests, if any, which interests aze hereby released and
<br />waived; all of which, including replacements and additions thereto, is hereby declared to be a part of the real estate
<br />secured by the lien of this Deed of Trust and all of the foregoing being referred to herein as the "Property".
