Lindquist, a member of the <br />Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a power of sale <br />contained in that certain Deed of Trust recorded on December 15, 2004 as Instrument No. 0200412034 in the <br />office of the Register of Deeds of Hall County, Nebraska, and Nationstar Mortgage, LLC, hereinafter called <br />"Grantee ". <br />WHEREAS, on November 24, 2010, Grantor, executed a Notice of Default pursuant to <br />which notice was given to James L. Simmerman, a single person, and Stacy L. Powell, a single <br />person, Trustors, under that certain Deed of Trust recorded on December 15, 2004 as Instrument <br />No. 0200412034 in the office of the Register of Deeds of Hall County, Nebraska, covering that <br />certain premises described as: <br />THE WEST FIFTY (50) FEET OF LOTS EIGHT (8) AND NINE (9) IN COURT <br />HOUSE ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, <br />NEBRASKA, <br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting forth the <br />nature of such breach and of his election to sell or cause to be sold such property to satisfy the <br />obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of Hall County, <br />Nebraska, on November 29, 2010, as Instrument No. 201008841. <br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice <br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76 -1008. <br />Subsequent thereto, beginning on April 25, 2011, Grantor caused to be published in The <br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a <br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the <br />described property would be sold at public auction to the highest bidder for cash or certified or <br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street, Grand <br />Island, Hall County, Nebraska at 2:00 PM on June 8, 2011. Publication of such notice was made for <br />five consecutive weeks on April 25, 2011, May 2, 2011, May 9, 2011, May 16, 2011 and May 23, <br />2011, the last publication being at lcast ten (10) days but not more than thirty (3 0) days prior to the <br />date of sale. <br />A copy of such notice of the time and place of sale was thereafter mailed to all parties entitled to <br />notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76 -1008. <br />Pursuant to said Notice of Trustee's Sale, John M. Cunningham, attorney for Grantor, did at <br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public <br />auction, and did sell the same to Grantee for the sum of $71,496.58, it being the highest bidder <br />therefor. <br />NOW, THEREFORE, in consideration of the premises and of the sum of $71,496.58 so bid <br />and paid as aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its successors and <br />assigns forever, all the estate, right, title and interest of which the said James L. Simmerman, a <br />single person, and Stacy L. Powell, a single person, and their successors in interest, were seized or <br />possessed at the time said Deed of Trust was given, or at any time thereafter, in and to the premises <br />sold as aforesaid, to -wit: <br />JME <br />
