Soukup ("Borrower") and <br />Robert A. Wallace and Mildred M. edallace, husband and wife, ("Lender"). <br />k <br />�� <br />� <br />� <br />rl� <br />THAT WHEREAS, the Lender agrees to ad�ance to �e Borrower the sum of One Huadred Twenty Thousand <br />Dollars ($120,000.00) (the "Loan"), evidence by the Promissory Note {"Note") from tlie Borrower to the Lender, dated the <br />s�ne date as this Deed of'IYust, wlrich together with any amowtrts advanced to protect the security of this Deed of Trust <br />shall be the total amount secwed. <br />AND WHEREAS, it has l�n agreed the Loan will be advanced, subjext to the terms and conditions for repayment <br />and use of the property as set forth in the Note and this Deed of Trus� <br />AND WHEREAS, it has been agreed the Loan shall be secured by the conveyance of the land descn`b�ed in this <br />Deed of Tivst. <br />NOW, THEREFORE, in consideration of the premises and for TEN DOLLARS ($ lO.OQ) paid by die Tn�stee, the <br />receipt of which is hereby acknowledged, the Borrower has bargained and sold by these preseats does bargain, sell and <br />convey unto the Trustee, and the Trustee's heirs, with all heating, plumbing and lighting fixtures-and equipmeut now or <br />hereafter attached to or used in connection with the premises (the "Property"). <br />S�e Eghibit A attached 8ereto and incor�r�ted herein by reference <br />'T� HAVE AND TO HOLD the Property, with all privileges and �purtenances thereunto belonging to the 'IYustee, the <br />'lYustee's heirs, sucessors and assigns foreverm upon the trast, terms and conditions and for the uses set forth in the I?e�i of <br />TYust <br />If there shall be azry default in any of the terms, convenents or cond'utons of the Nate, the terms uf which are made a part <br />of this I�ed of Trusst and 'mcor�rate.d by reference, or any failure or neglext to comply to the satisfaction of the Lender <br />with the covenants, terms or conditions contained in this D�ed of Trust, then, and in any such events, if the default is not <br />made good within the time period set out to cure such default, or if none is set out withing tlurty (30) days, the Note shall, at <br />the option of and upon demand of the Lender, ax once become due and payable, and it sball be lawfi�l for and the duty of the <br />Trustee, u�n request of tbe Lender, to sell the Praperty at Public Auction for cash, after having first given such notice of <br />hearings as to then required by law and giving notice of and advertising the time and pl�ce of saale in the manner as may be <br />�en provided by law and upon sale aa�d any resale and upon compliance witi� the law then relating to foreclosure <br />proceedings and obtain findings or leave of court as may be then required by law and giving notice of and advertising the <br />time and place of sale in the manner as may be provided by law, and upon sale and any resale and upon compliance with the <br />law tlien reiating to foreclosure proceedings to convey the title to the purchaser in fee simple.
