201103885 <br />NON-iJNIFORM COVENANTS. Borrow� and Lender fi�rtber covenant and agr� as follows: <br />22. Acceleral3on; Remedies. Lender shall glve notfce to Borrower prior to acceleradon followiing <br />Borrower's breach of any covenant or agreement in this 5ecnntty Instrament (bnt not prior to <br />acceleration under SecHon 18 unlesa Applicable Law provides otherwise). The notice shall apec�lfy: (a) <br />the defanit; (b) the action required to cnre the default; (c) a date, not less than 30 daps from the date <br />the notice �ts given to Borrower, by wluich the defanit must be cnred; and (� that failnre to cure the <br />defanit on or before the d�te sgedfled �in the notice may re,gnit in acceleration of the snms secared by <br />tivls Secnrity Instrament �nd sale of the Property. The notice shall fnrther 3nform Borrower of the <br />right to reinstate after acceleration and the right to bring a court act3on to assert the non e�dstence of <br />a defanit or any other defense of Borrower to acceleradon and sale. If the defanit is not cured on or <br />hefore the date specifled in the notilce, Lender at its option may reqnire immedi�te payment in foll of <br />all sums secnred by this Secnrity Instrament witho� fnrther demand and may invoke the power of <br />sale and any other remedies permitted by Applic�ble Law. Lender shall be entitled to collect all <br />eggenses 3ncnrred in pnrswing the reme.�lies provided in tLis 5ectlon 2Z, inclnding, bnt not lim�ited to, <br />reasonable attorneys' fees and cost� of tltle evidence. <br />If the gower of sale is invoked, Traste.e shall r�ord a notice of defanit in each county in which <br />any part of the Property is located and shall mail copies of snch nodce in the m�nner preacrlbed by <br />Applicable Law to Borrower and to the other persons prescrib� by Applicable Law. After the dme <br />reqnired by Applicable Law, Trastee ahall give pnblic noHce of sale to the persons and in the manner <br />prescribed by Applicable Law. Trastee, withont demand on Borrower, shall sell the Property at <br />pnblic auction to the highest bidder at the 13me and place and nnder the terms designated 9n the <br />notice of sale �in one or more parcels and in any order Trastee determ�nes. Trastee m�y gostpone sale <br />of all or any parcel of the Property by pnblic annonncement at the ttme and place of any previonsly <br />schednled sale. Lender or its designce may pnrchase the Property at any sale. <br />Upon receipt of gayment of the price bid, Traste�e ahall deliver to the purchaser Trast�'s deed <br />conveying the Property. The redtals in the Trastee's deed ah�ll be prima fade evitdence of the trath <br />of the statements made therein. Trastee shall apply the proceeds of the sale in the following order: (a) <br />to all costs and egpenses of egerdsing the power of sale, and the sale, inclnding the payment of the <br />Trnstee's fees actn�lly incurred and reasonable attorneys' feRS as perm�ttted by Applicable Law; (b) to <br />all snms secnred by this Secnrity Instrament; and (c) any ezcess to the peraon or persons legally <br />ent�tled to it <br />23. Reconveyance. UP� PaY�nt of all sums securefl by this Security Ins�ment, Lender shall <br />request Trustee to reconvey the Property and shall swreader this Se�urity Instrument and all notes <br />evidencing debt secureri by this Seeurity Instrument to Trust�. Truste,e shall reconvey the Properiy <br />without warranty to the person or persons legally entitled to it Such person or persons shall PaY �Y <br />recordation costs. Lender may charge such person or persons a f� for reconveying the Property, but only <br />if the fce is paid to a third party (such as the Trust�) far services rmdered and the charging of the f� is <br />permitted tmder Applicable Law. <br />24. Snbstitate Trastee. Lender, at its option, inay from time to time remove Trustee and appoint a <br />succxsssor truatee to any Trustee appointed hereunder by an instnmaent recorded in the county in which this <br />S�urity Instiument is r�orded. Without conveyance of the Property, the successor trustee shall sucxee� to <br />all the title, power and. dulies conferred upon Trustee herein and by Applicable Law. <br />25. Reqnest for No13ces.
