201103756 <br />NON iJNIFORM COVENANTS. Bortower and Lender further covenant and agree as follows: <br />22. Acceleradon; Rem�Yes. Lender ahall give notice to Borrower prior to accelera�ton following <br />Borrower's breach of any coven�nt or agr�ment in this Secnrity Instrument (bnt not prlor to <br />acceleration nnder Sectton 18 unl�s Applicable Law provides otherwise). The nodce shall spedfy: (a) <br />the defanit; (b) the action r�wtred to cnre the defanit; (c) a date, not less than 30 days frnm the date <br />the notice is given to Borrower, by which the defanit muet be cnred; and (� that failnre to cure the <br />defanit on or before the date spedfled in the notice may resalt �in accelerai3on of the sams secared by <br />th3s Security Instrument and sale of the Property. The notice shall fnrther �inform Borrower of the <br />right to re�nstate �fter acceleration and the right to bring a court action to assert the non eglstence of <br />a defanit or any other defense of Borrower to acceleration and sa1e. If the defanit is not cnred on or <br />before the date spedfled in the nodce, Lender at its option map r�nire immediate payment in fnll of <br />all sams secnral by this 5ecnrity Instrument withont fnrther demand and may invoke the power of <br />sale and any other rem�tes germitted by Appl�lcable Law. Lender shall be entitled to coIIect all <br />egpenses �incarred in pnrswtng the remedies prov�lded in this Sectiton 22, incinding, but not limited to, <br />reasonable attorneys' f� and costs of title evidence. <br />If the gower of sale is �lnvoked, Trustee shall record a notice of defanit in each connty in wLich <br />any part of the Properiy is located and shall mail copiea of sach notice �in the manner prescribed by <br />Applicable Law to Borrower and to the other persons prescrYbed by Applicable Law. After the blme <br />reqwired by Applicable Law, Trnste:e shall gtve pnblic nol3ce of sale to the persons and �in the manner <br />presci3b� by Applicahle Law. Trastee, withont demand on Borrower, shall sell the Progeriy at <br />pnblic anctlon to the highest bidder at the time and place and nnder the terms des�tgnated 3n the <br />notice of sale �ln one or more parcels and �ln any order Trustee determines. Trastee may postpone sale <br />of all or any parcel of the Property by pnblic annonncement at the time and glace of any previonsly <br />schednled sale. Lender or �lts des�ignee may pnrchase the Property at any sale. <br />Upon receipt of payment of the prlce bid, Trastee ahall deliver to the pnrchaser Trastee's deed <br />conveyflng the Property. The recitals �1n the Trnstee's deed shall be prima fade evidence of the trath <br />of the statements made therdn. Trastee sha11 apgly the proceeda of the sale in the following order: (a) <br />to all costs and ezpenses of ezercising the power of sale, and the sale, inclading the payment of the <br />Trastee's f� actaally �incnrred and reasonable attorneys' fees as permitted by Applicable Law; (b) to <br />all sums secnred by this Security Instrament; and (c) any egc�s to the person or persons legally <br />entitled to i� <br />23. Re.conveyance. Upon payment of all sums se�ure� by this Security Instrument, Lender shall <br />r�t Trustea to reconvey the Properiy and shall suirender this Security Instrument and all notes <br />evidencing debt s�ured by this Security Instrument to Truste,e. Trustce shall re�onvey the Property <br />without warranty to the person or parsons legally entitled to i� Such person or persons shall pay any <br />recordation costs. Lender may charge such person or persons a fee for rec:onveying the Properiy, but only <br />if the fee is paid to a third pazty (such as the Trust�) for services rendered and the chazging of the f� is <br />permitted under Applicable Law. <br />24. Snbstitate Trast�. Lender, at its option, may from time to time remove Trustee and appoint a <br />successor trust� to any Trustee appointed hereunder by an instrument recorded in the county in which this <br />SecuritY Inst�vment is recorded. Without conveyance of the Properiy, the successor trustee shall succeeci to <br />all the title, power and duties confeired upon Trustee herein and by Applicable Law. <br />25. R�nest for Nol3cc,c.
