Cheese" or <br />equivalent use, and (B) the front doors of the "Dave & Buster's," <br />"Chuck E. Cheese" or equivalent use shall not be located within <br />two hundred (200) feet of the front and side perimeter walls of the <br />Premises; <br />so-called "flea market"; or second hand, used goods or <br />consignment store, excluding a seasonal farmers market; <br />store selling primarily distressed or damaged merchandise; <br />so-called "head shop"; or night club; <br />gun range; <br />leasing for a warehousing use (except for existing tenants who use <br />tenant space for storage), except as incidental to a retail business; <br />adult book store or store selling or exhibiting pornographic <br />materials; <br />intentionally deleted; <br />business office usage, except that real estate brokers, insurance <br />services, tas� preparation services, chiropractic, stock brokers, title <br />companies, medical offices, law offices and similar retail service <br />office uses as are typical for comparable shopping centers in the <br />Grand Island, NE geographical area ("Retail Service Offices") <br />shall be permitted, provided that such Retail Service Offices, in the <br />aggregate, do not exceed ten percent (10%) of the Gross Leasable <br />Area of the Shopping Center; <br />animal kennel; laundromat; and, <br />any non-retail use in excess of 10% of the Gross Leasable Area of <br />the Shopping Center; provided, however that the items permitted in <br />paragraph (�i) above shall not be included in the calculation of <br />the 10% limita.tion hereunder. <br />5. This Memorandum of Lease is intended solely to establish the Lease and the <br />rights of Tenant in respect of the Premises as matters of public record. Reference <br />is hereby made to the Lease for a complete description of a11 of the rights, duties, <br />and obligations of the parties in respect of the Premises and the use and the <br />occupancy thereof. In the event of any inconsistency between the Lease and this <br />Memorandum of Lease, the Lease shall control. <br />3 <br />
