�01�03��� <br />POEHLER for the construction of a natural gas line in and under a <br />portion of their properties (herein referred to as the "Easement Area"), <br />which is legally described as follows: <br />The Southeast Quarter (SE1/4) of the Southeast Quarter (SE1/4) of the <br />Southeast Quarter (SE1/4), of Section Twelve (12), Township Ten (10) <br />North, Range Thirteen (13) West of the 6�' P.M., of Buffalo County, <br />Nebraska, and <br />The South Seventy-five feet (75') of the West Half (W 1/2) of the <br />Sauthwest Quarter (SW 1/4) of Section Seven (7), Township Ten (10) <br />North, R.ange Twelve (12) West of the 6�' P.M., of Hall County, <br />Nebraska.. <br />FOR AND IN CONSIDERATION of the mutual covenants, benefits, and promises set <br />fotth hereinafter, it is agreed among the parties as follows: <br />1. Grant of Easement. DUBBS and HANNON grant to POEHLER, and to his <br />successors and assigns, the right to construct, own, maintain, repair and replace a natural gas line <br />to be constructed within the Easement Area, and which serves the Poehler Property. <br />2. Covenants of POEHLER. POEHLER covenants and agrees to repair any damage <br />done to the Easement Area caused by POEHLER's use, maintenance, repair or replacement of <br />the natural gas line. <br />3. Covenants of DUBBS and HANNON. DUBBS and HANNON agree that they will <br />not obstruct or interfere with POEHLER's rights hereunder. <br />4. Indemnification. POEHLER agrees to indemnify DUBBS and HANNON and to <br />hold them harmless from and against any and all claims arising out of its use of the Easement <br />Area, or by any of his guests or invitees; provided that this indemnification shall not extend any <br />liability arising out acts or omissions of DUBBS or HANNON, or of their agents or employees. <br />5. Term of Easement. This easement shall be permanent, and shall run with the land. <br />The ea.sement crea.ted hereby is superior the rights of the parties or their successors in the <br />Page 2 of 4 <br />
