Lender and Trustor have entered into a Deed of Trust dated April 8, 2004 (the "Deed of Trust") which has been recorded <br />in HALL County, State of Nebraska, as follows: <br />RECORDED ON 4-27-2004, IN THE AMOUNT OF $10,000.00 IN INSTRUMENT N0. 0200404120. <br />REAL PROPERTY DESCRIPTION. The Deed of Trust covers the following described real property located in HALL County, State of <br />Nebraska: <br />LOT 4 IN "ROUSH PLEASANTVILLE TERRACE SUBDIVISION" OF PART OF MATTHEW'S SUBDIVISION OF PART OF THE NW 1/4 OF <br />SECTION 27 IN TOWNSHIP 11 NORTH, RANGE 9 WEST OF THE 6TH P.M. IN HALL COUNTY, NEBRASKA, AS SURVEYED, PLATTED <br />ANO RECORDED. <br />The Real Property or its address is commonty known as 106 BROOKLINE DR, GRAND ISLAND, NE 68801. The Real Property tax <br />identification number is 400086476. <br />MODIFICATION. Lender and Trustor hereby modify the Deed of Trust as follows: <br />EXTENDING MATURITY DATE TO 3-75-2015. <br />CONTINUING VALIDITY. Except as expressly modified above, the terms of the original Deed of Trust shall remain unchanged and in full <br />force and effect. Consent by Lender to this Modification does not waive Lender's right to require strict performance of the Deed of Trust <br />as changed above nor obligate Lender to make any future modifications. Nothing in this Modification shall constitute a satisfaction of the <br />promissory note or other credit agreement secured by the Deed of Trust (the "Note"). It is the intention of Lender to retain as liable all <br />parties to the Deed of Trust and all parties, makers and endorsers to the Note, including accommodation parties, unless a party is expressly <br />released by Lender in writing. Any maker or endorser, including accommodation makers, shall not be released by virtue of this <br />Modification. If any person who signed the original Deed of Trust does not sign this Modification, then all persons signing below <br />acknowiedge that ihis Modification is given conditionaliy, based on the representation to Lender that the non-signing person consents to <br />the changes and provisions of this Modification or otherwise will not be released by it. This waiver applies not only to any initial extension <br />or modification, but also to all such subsequent actions. <br />OCCUPANCY (TITLEI. By signing this form, we acknowledge that the intent of our loan is to obtain financing which is, or will be, secured <br />by a dwelling that we will use as our principal residence. If we are not already doing so, we wilt occupy this residence within 60 days <br />after the closing of our loan. <br />We also� recognize that if we do not inhabit the residence as we have agreed to, we may be in default. If that occurs, State Farm Bank, <br />F.S.B. will have the right to recall our loan, and to demand the immediate payment of the full balance due, plus any other expenses <br />incurred in this respect.
