2011029�� <br />The undersigned is the Secretary of Rainbow Lake Homeowner's Association, <br />Inc., a non-profit corporation, and by execution hereof, states and affirms that at an <br />annual meeting of the Corporation held on Apri128, 2010, a majority of the owners of the <br />lots voted to adopt this Amendment of the Agreement for Protective Covenants, <br />Restrictions and Conditions for Rainbow Lake Subdivision, Rainbow Lake Second <br />Subdivision, Rainbow Lake Third Subdivision, Rainbow Lake Fourth Subdivision, and <br />Rainbow Lake Fifth Subdivision. <br />The following Restrictive Covenants are hereby amended: <br />1. Paragraph 11 of said Agreement for Protective Covenants, Restrictions <br />and Conditions recorded as document number 2002-08608 on August 16, 2002 and as <br />amended (but not recorded) in 2004, shall be deleted and replaced by the following <br />paragraph: <br />11. Each lot Owner or tenant, his family, and invitees, shall have the <br />privilege of using the lake located in the Subdivisions, as it may exist from <br />time to time, for swimming, fishing, and boating; provided that only said <br />boats not powered by fossil fuels shall be allowed, including but not <br />limited to, sailboats, row boats, canoes, pontoon boats, and any other <br />floating devices propelled by human power or electric motor, whereby the <br />electric trolling motor shall not exceed 165 pounds thrust. All boats <br />propelled by engines using fossil fuels are prohibited, and all boats with <br />electric motors exceeding 165 pounds thrust are prohibited. Boating and <br />fishing shall not be permitted closer than forty (40) feet from the shoreline <br />in any location, except that each lot Owner or tenant, his family and <br />invitees may swim, fish and boat within the forty (40) feet area <br />immediately adjacent to such lot Owner or tenant's shoreline The Owner <br />or tenants of each lot shall take all precautions to avoid polluting or <br />littering the lake in the Subdivisions. <br />2. Paragraph 15 of said Agreement for Protective Covenants, Restrictions <br />and Conditions recorded as document number 2002-08608 on August 16, 2002, shall be <br />deleted and replaced by the following paragraph <br />
