GOTTLOB, husband and wife, hereinafter referred to �, <br />as "GRANTORS", and in consideration for cancellation of indebtedness in the sum of $254,120.25, /b � <br />do hereby grant, bargain, sell and convey and confirm unto PATHWAY BANK, a Nebraska <br />Corporation, hereinafter referred to as "GRANTEE", the following described real property in Hall <br />County, Nebraska, to-wit: <br />Lot One (1), N& J Subdivision in the City of Grand Island, Hall County, Nebraska. <br />TO HAVE AND TO HOLD the above described premises, together with all tenements, <br />hereditaments, and appurtenances thereunto belonging to the GRANTEE, and to its successors and <br />assigns forever. <br />GRANTORS do hereby covenant with the GRANTEE and GRANTEE'S successors and <br />assigns that GRANTORS are: <br />(a) lawfully seized of said premises; <br />(b) that said premises are free and clear of all encumbrances except easements, <br />covenants and rest::ctions of record. <br />(c) that said premises are further free from liens for unpaid real estate taxes except for <br />the year 2009 plus interest, together with real estate t�es through 2010, which have not yet been <br />determined; <br />(d) that no unpaid debts for fixtures, building products, labor, or materials used in the <br />construction or any improvements to the above described property currently exists, and that <br />GRANTORS will save and indemnify the GRANTEE harmless from any claim arising by virtue of <br />any labor or materials used in the construction or remodeling or improvements done to the <br />premises. <br />The GRANTORS further warrant that they have good right and lawful authority to convey <br />the above-described premises and that GRANTORS will warrant and defend the title to said <br />premises against the lawful claims of all persons whomsoever. <br />This Deed is intended as an absolute conveyance of title in effect as well as in form, and is <br />not intended as a mortgage, trust conveyance, or security of any kind. <br />DATED THIS � �'�day of December, 2010. <br />/ <br />,% _ <br />eil Gottlob, Grantor <br />f <br />, �� <br />dy G.
