<br />Know All Men By These Presents, That, Whereas, ACL COMPANY, LLC, a Minnesota limited liability
<br />company, (the "Borrower") of the County of Hall, State of Nebraska, by Deed of Trust dated the 1�` day of
<br />February 1996, executed by Borrower, as Trustor, in which AG CAPITAL COMPANY, a Delaware
<br />corporation, is named as the initial Beneficiary and �OBERT M. GONDERINGER, Attorney-at-law, as
<br />Trustee, was duly recorded in the office of the Register of Deeds of the County of Ha11, in the State of
<br />Nebraska, on the 16th day of February 1996, as Document No. 96-101144; and
<br />Whereas said Deed of Trust was amended by a certain First Amendment to Deed of Trust dated March 6,
<br />2003 and filed for record on March 18, 2003 as Document No. 0200303169, and assigned to

<br />Whereas said Deed of Trust was further amended by a certain Second Amendment to Deed of Trust dated
<br />February 12, 2006 and recorded on July 11, 2006 as Document No. 0200606178; and
<br />Whereas ROBERT M. GONDERINGER, Attorney-at-law, as Deed Trustee was substituted by BRUCE I.
<br />SMITH, Attorney-at-Law, by Substitution of Trustee recorded July 11, 2006 as Document No.

<br />Whereas said Deed of Trust conveyed the following real estate described in said Deed of Trust to secure
