<br />Randolph L. Dibbern and Carrie J. Loy, being first duly sworn upon their oaths, depose
<br />1. That the Affiants are the successor cotrustees under the terms and conditions of the
<br />William H. Dibbern Revocable Trust dated November 25, 2003, which is now known as the William
<br />H. Dibbern Administration Trust (hereinafter referred to as the "said Trust").
<br />2. That on January 26, 2011, the �ants became the successor cotrustees of the said
<br />Trust following the death of William H. Dibbern on January 26, 2011, the settlor and initial trustee
<br />of said Trust, a certified copy of his death certificate is attached as E�ibit "A", and upon signing an
<br />Acceptance to Act as Cotustees under the William H. Dibbern Revocable Trust dated March 22,
<br />2011, an original of which is attached as E�ibit "B".
<br />3. That the Affiants remains the sole cotrustees of the said Trust as of this date.
<br />4. That among the assets of the said Trust is the following described real property that
<br />was conveyed to the trustee of the said Trust on November 25, 2003, by Warranty Deed recorded
<br />on November 26, 2003, of the records of the Hall County Register of Deeds Office as Instrument No.
<br />200315415:
<br />An undivided 13/16ths interest in and to the Southwest Quarter (SWl/4) of

<br />The Northwest Quarter of the Northwest Quarter (NWl/4NW'/4) and the West
<br />Half of the Northeast Quarter of the Northwest Quarter (W of
<br />Section Three (3), Township Eleven (11) North, Range Eleven (11) West of the
<br />6"' P.M., Hall County, Nebraska;
<br />T��e Southwest Quarter of the Northwest Quarter (SW'/4NW and the West
<br />Half of the Southeast Quarter of the Northwest Quarter (W%ZSE'/4NW'/4) all in
<br />Section Three (3), Township Eleven (11) North, Range Eleven (11), West of the

<br />West of the 6�' P.M., Hall County, Nebraska, EXCEPTING therefrom a tract
<br />of land more particularly described as Roth Second Subdivision, Hall County,
<br />Nebraska, and EXCEPT Lot 1, CJL Subdivision, Hall County, Nebraska.
<br />5. That pursuant to the terms ofthe said Trust and §30-3881(2) oftheNebraska Uniform
<br />Trust Act, the cotrustees of the said Trust have the power, without court authorization, to acquire
<br />or sell property, for cash or on credit, at public or private sale.
<br />6. That neither the said Trust or the trust instrument creating the said Trust, nor any part
<br />thereof, has been revoked, amended, or terminated, and the above statements constitute a full
<br />disclosure of all provisions concerning those items.
