<br />WILLIAM A. FRANCIS, a Member of the Nebraska State Bar Association, #11366, as i� uD
<br />Successor Trustee, does hereby grant, transfer and convey, without covenant or warranty, expressed
<br />or implied, to EXCHANGE BANK, (hereinafter called "Grantee"), the following described real
<br />property: '
<br />The West 22 Feet of the South Half of Lot Six (6), Block Fifly-four (54),
<br />Original Town, now City of Grand Island, Hall County, Nebraska, and
<br />The East 28 Feet of the Southerly 66 feet and a strip of ground 6 feet in
<br />width by 38 feet in length of the Northerly end of the West 38 feet of the
<br />South 66 feet in Lot Five (5), Block Fifly-four (54) of the Original Town,
<br />now City of Grand Island, Hall County, Nebraska.
<br />together with all buildings, improvements, fixtures, accessories and appurtenances thereto
<br />belonging.
<br />To have and to hold the above-described property unto the Grantee, its successors and
<br />assigns.
<br />This conveyance is made pursuant to the powers conferred upon the Successor Trustee by a
<br />certain Deed of Trust dated August 5, 2005, executed by Nickie J. Kallos, Jr., a Single Personal,
<br />Rosemary K. �Kallos and Nickie J. Kallos, Wife and Husband, as Trustors. The Deed of Trust was
<br />recorded on August 12, 2005, as Instrument No. 200507864, of the records in the office of the Hall
<br />County Register of Deeds, to secure the payment of a Promissory Note in the original principal sum
<br />of Sixty Five Thousand Three Hundred Thirty Eight Dollars and Fifty Cents ($65,338.50) and
<br />interest as therein provided.
<br />Default has occurred under the terms of said Deed of Trust and the obligations secured
<br />thereby, as more particularly set forth in the Notice of Default recorded December 17, 2010, in the
<br />Office of the Hall County Register of Deeds, as Instrument No. 0201009413. On December 22,
<br />2010, a copy of the Notice of Default together with recording data shown thereon was mailed to the
<br />Trustor by certified mail, return receipt requested.
<br />After the lapse of not less than one (1) month, WILLIAM A. FRANCIS, Successor Trustee,
<br />caused a Notice of Trustee's Sale to be published as required by law in The Grand Island
<br />Independent, a newspaper having general circulation in Hall County, Nebraska. The publication
<br />was run once a week for five (5) consecutive weeks, with the last publication occurring on February
<br />17, 2011. A copy of the published Notice of Trustee's Sale was mailed to the Trustors as required
<br />by law.
<br />All applicable statutory provisions of the Statutes of the State of Nebraska and all
<br />provisions of the above-described Deed of Trust have been fully complied with as to the acts to be
<br />performed and notices to be given.
<br />The above-described real property was sold at public auction at the time and place of sale to
<br />the Grantee, it being the highest bidder at said sale, for the sum of Seventy Two Thousand Dollars
<br />($72,000.00). The sale was conducted on the 1 st day of March, 2011, at 9:30 o'clock a.m., the date
<br />and time set forth in the Notice of Sale.
<br />IN WITNESS WHEREOF, the undersigned Successor Trustee has executed this Trustee's
<br />Deed on the 1 st day of March, 2011.
