<br />(b) As ►7�ay be permitted by law, after deducting all costs, fees, expenses of
<br />Trustee and of this Trust, including c;asts of evidence af title in connection with sale,
<br />Trust�e shall apply tt�e proceecls af sale tc� payrnent crf (i) all sums expended uncler the
<br />terrns r�ereof, not then repaid, with ac,cri.iec� interest at ten (10%) percent per annum, (ii)
<br />a!I ather sums then secured hereby, and (iii) the rernainc�er, if any, to the person c�r
<br />persons legally entitled thereto.
<br />(c) Trustee may, in the manner provi.ded by law, pastpone sale af all or any
<br />portion af tt�e - frust Estate.
<br />12. REMEDIES NQT EXC;LUSIVE. Trustee and Beneficiaries, and each af them,
<br />shal! be entitlecl to enforce payment and perforrnance of any ind�k�tedness or obligations
<br />secured heret�y and to exercise all rights anei �,owers ur}der this Ueed of Trust or under
<br />any Loan Instrw�nent or other agreement or any laws now or hereafter in force,
<br />notwithstanding sorne ar all of the suc,l� indebtedness anc� oraligations secured hereby
<br />n�ay now or hereafter be otherwise secured, whettier by mortgage, deed of frust, plecige,
<br />lien, assignment or otherwise. �leither the acceptance of fihis Deed of Trust nor its
<br />enf�rcement whether by court actian or purs�.iant to the power of sale or other powers
<br />herein contained, shall prejudice or in any rnanner affect T�rustee's or Beneficiaries' right
<br />t� realize upon or enfarce any other seciarity now ar hereafter held by Trustee or
<br />Beneficiaries, it being agreed that Trustee and Beneficiaries, anci each c�f them, shall k�e

<br />which either of them r7�ay be c�t�ierwise enfiitled, may be exerc:ised, concurrently or
<br />independently, fram time to time, and as c�ften as rnay k�e deemed expedienf by Tr�ustee
<br />or Beneficiaries; and either of them rnay pursue inconsistent remedies. Nothing herein
<br />sj�aJl be construecl as prohibiting f3er�efic;iaries fr�om s�eking a deficiency j�idgrnent
<br />ac�ainst the to the extent such aciion is penr�ittec� by law.
<br />13. REQUEST FOR NUTIC�. Trustors hereby request a copy of any notice of
<br />default, and that any notic;e af sale hereunder be rr�ailed to t.herr7 at the acadress set farth
<br />in ti�e first paragraph of this Deed of �Trust.
<br />14. GOVERNING I.AW. This need of Trust shall k�e y�verned by the laws of the
<br />State of Nebraska. !n the event that any provision or clause of any of ttie 1_oan
<br />Instruments conflicts with a�plicable laws, such confli�ts sl�all nat affect other �rovisic�ns
<br />of such Loan Instruments wt7ict► can be given efiFect witho��t the confilicting provisions; and
<br />to this end, the provisions of the Laan Instr�.irY�ents are declared to be severable. Tt�is
<br />insfirument cannot be waived, changed, discharged, or terminated orally, but only by an
<br />instrument in writing signed by the party against whorn enforcernent of any waiver,
<br />change, discharge or termination is so�ight.
<br />15. aEGONVEYANCE BY T�2USTEE. Upon wrikten request of Beneficiaries
<br />stating that all sums secured hereby t�ave been paid, and upon surrender of khis Deed of
<br />Trust and the Note to Trustee for canc;ellation and retentic�n and �ipon payment t�y
<br />Trustors of Trustee's fees, Trustee shall reconv�y t�, or the person or persans legally
<br />entitled fihereto, without warranty, any portion ofi the Trust Estate then held hereunder.
<br />l�he rer,itals in such reconveyance of any n�atters or facts st�all be conrl��sive proofi of the
<br />tr��thfulr�ess tl�ereof. The grantee in any reconveyanr.e may be described as "the person
<br />ar persans legally entitled thereta".
<br />16. NQTICES. Whenever Benefiiciaries, Trustars or Trustee shall desire to give or
