<br />TO WHOM IT MAY CONCERN:
<br />You are hereby notified that Ismael Zarate and Maria Zarate, as husband and wife, as Trustors, did on or about
<br />April 21, 2001, make, execute and deliver unto First American Title Insurance Company, Trustee, a Deed of Trust
<br />wherein said Trustors conveyed the following-described real property:
<br />LOT 1, BLOCK 39, RUSSEL WHEELER'S ADDITION TO THE CITY OF
<br />GRAND ISLAND, HALL COUNTY, NEBRASKA
<br />as security for repayment of a loan which the Trustors obtained from Mountain West Financial, Inc. , Beneficiary of
<br />said Deed of Trust which was recorded on May 1, 2001, in the office of the Register of Deeds of Hall County,
<br />Nebraska, as Instrument No. 02001-03974.
<br />On or about April 27, 2001, Mountain West Financial, Inc., Beneficiary, assigned all of its right, title and
<br />beneficial interest in the Deed of Trust to Fleet National Bank. The Assignment was recorded May 1, 2001, in the
<br />office of the Register of Deeds of Hall County, Nebraska, as Instrument No. 02001-03975.
<br />On or about May 22, 2002, Washington Mutual Home Loans, Inc. f/k/a Fleet National Bank, Beneficiary,
<br />assigned all of its right, title and beneficial interest in the Deed of Trust to Mountain West Financial, Inc. The
<br />Assignment was recorded May 22, 2002, in the office of the Register of Deeds of Hall County, Nebraska, as Instrument
<br />No. 02002-05506 and rerecorded on June 17, 2002, as Instrument No. 02002-06427.
<br />On or about May 22, 2002, Mountain West Financial, Inc., Beneficiary, assigned all of its rights, title and
<br />beneficial interest in the Deed of Trust to Homeside Lending, Inc. The Assignment was recorded May 22, 2002, in the
<br />office of the Register of Deeds of Hall County, Nebraska, as Instrument No. 02002-05507.
<br />On or about December 9, 2002, Homeside Lending, Inc., Beneficiary, assigned all of its rights, title and
<br />beneficial interest in the Deed of Trust to MidFirst Bank. The assignment was recarded December 9, 2002, in the office
<br />of the Register of Deeds of Hall County, Nebraska, as Instrument No. 02002-13628.
<br />Modification Agreements were filed in the office of the Register of Deeds of Hall County, Nebraska on May
<br />19, 2006, as Instrument Na. 02006-04435, September 12, 2007, as Instrument No. 02007-07886 and July 21, 2009, as
<br />Instrument No. 02009-05982.
<br />Camille R. Hawk, Attorney at Law, has been appointed Successor Trustee, pursuant to a Substitution of
<br />Trustee filed for record with the Register of Deeds of Hall County, Nebraska.
<br />You are further notified that there has occurred a breach of an obligation of the Trustars for which the Trust
<br />property was conveyed as security, to-wit, that the Trustors have failed to pay the Beneficiary payments that were
<br />contractually due.
<br />You are further notified that if the default breach is not cured within the redemption timeframe allowed for
<br />under the Nebraska Trust Deeds Act (Neb. Rev. Stat. §76-1001 to §76-1018), the Beneficiary has elected to and does
<br />declare the entire unpaid principal balance, together with interest thereon, at once due and payable, and the Trustee has
<br />elected to sell or cause to be sold the real property described in said Deed of Trust to satisfy said obligation.
