<br />THIS NOTICE OF DEFAULT is given by Rana A. Scarlett-Johnson ("Trustee"), as the
<br />Substitute Trustee under a certain Deed of Trust executed by Joel Shafer as President of Shafer
<br />Properties, LLC, ("Trustor") on October 17, 2006, and recorded on October 19, 2006 as
<br />Instrument Number 0200609333 in the records of the Register of Deeds of Hall County,
<br />Nebraska and, covering the following described real estate (hereinafter referred to as the "Trust
<br />Property"):
<br />Lots One (1), Two (2), and Three (3), Block One (1) and Lots (1), Two (2}, and Three
<br />(3), Block Two (2), Santa Anita Estates Second Subdivision, in the City of Grand Island,
<br />Hall County, Nebraska, and Lots Five (5) and Six (6), Santa Anita Estates Subdivision in
<br />the City of Grand Island, Hall County, Nebraska, as more particLilarly identified and
<br />described in the Deed of Trust as 203, 204, 209, 210, 215, 216, 221 and 222 Saratoga
<br />Circle, Grand Island, Nebraska 68801.
<br />A breach of the obligations for which the Trust Property was conveyed as security has occurred
<br />in that Trustor, as borrower, has failed to pay to Mid City Bank-Branch 1("Beneficiary and
<br />Assignee"), the Beneficiary and Assignee, under the July 17, 2008 Assignment of Note and Deed
<br />of Trust recorded on September 10, 2008, as Instrument no. 0200807788 from the State Bank of
<br />Lebo to the Mid City Bank, when due the principal and interest due to the Beneficiary and
<br />Assignee under obligations of Trustor to the Beneficiary and Assignee which are secured by the
<br />Deed of Trust, including, without limitation, the Promissory Note from Trustor dated October
<br />17, 2006 in the original principal amount of $1,343,865.00.
<br />Trustee, with the agreement of the Beneficiary and Assignee, has elected to declare the entire
<br />unpaid principal balance and all accrued interest at once due and payable and has elected to sell
<br />or cause to be sold the Trust Property to satisfy said obligations.
