Lender shall give notice to Borrower prior to acceteration <br />foUpwing Borrower's breach of any covenant or agreement in this Security Instrument (but not <br />prfor to acceleration unc�r Section 18 uniess Applicabte l.aw provfdes otherwise). The notice <br />shali specify: (a) the default; (b) the action required to cure the default; (cj a date, not less than 30 <br />days from the date the notice is give» to Borrower, by which the defauk must be cured; and (d) <br />that failure to cure the default on or before the date specif'ied in the notice may resuk in <br />accelaration of the sums secured by this Security l�nstrument and sate of the Prvperty. The natice <br />shall further inform Borrower of !he right to reinstate after acceleration and the right to bring a <br />court action to assert the non-existence of a defauk or any other defense of Borrower to <br />acceieration and �ale. If the defauft is not cured on or before #he date specified in the notice, <br />Lender at its option may require immedia� payment in futl of all sums secured by tt�is Security <br />Instrument without further demand and may invoke the power of sale and any other remeclies <br />permitted by Applicable law. Lender shall be errtitted to collact all expenses incurred in pursaing <br />the remedies provided in this Sec:tion 22, including, but not timited to, reasonable attorneys' fees <br />and costs of title evidence. <br />lf the power of sale is invoked, Trustee shali record a notice of default in each courrty in <br />which any part of the Praperty +s located ar�d sfiall rnail copies of such notice in the manner <br />prescribed by Applicable Law to Borrower and to the other persons presc�ibed by Applicable <br />Law. After the time required by Applicable Law, Trustee shatt give pubtic notice of sale to the <br />persons and in the manner prescribed by Applicable Law. Trustee, without demand on Borrower, <br />shall sell the Property at pubiic auction to the highest bidder at the time and pface and under the <br />terms designated in the notice of sale in one or more parcels and in any order Trustee <br />determines, tn�stee may postpone sale of aN or any parcel of the Property by public <br />announcement at the tinne and place of any previously scheduled sale. Lender or its designee <br />may purchase the Property at any sa#e. <br />Upon receipt of payment of the price bid, trustee shall delivev to the purchaser Trustes's <br />deed conveying the Property. The recitals in the Trustee's deed shall be �rima #acie evidence of <br />the truth of the statements made therein. Trustee shall apply the proceeds of the saie in the <br />following order: (a) to all costs and expenses of exercising the power of sate, and the sale, <br />inciuding the payment of the 7rustee's fees actually incuned and reasonabie attomeys' fees as <br />permitted by Applicable Law; (b) tfl al! sums secured by this Security Instrument; and (cj any <br />excess to the person pr persons legally entitled to it. <br />23. Reconveyance. Upon payment of aN sums secured by this Security Instrume�t, lender shall <br />request Trustee to re-convey the Property and shall sunender this Security Instrument and all notes <br />evidencing debt secured by this Security Inshument to Trustee. Trustee shall recanvey the Property <br />without warranty to the person or persons legaily entitled to it. Such person or persons shall pay any <br />recordation costs. Lender may charge such person or persans a fee far reconveying the Property, but <br />only if the fee is paid to a third party (such as the Trustee) for senrices rendered and the charging of the <br />fee is perrnitted under Appticable Law. <br />24. Substitute Trustee. Lender, at its option, may from time to time remove Trustee and <br />appoint a successor trustee to any Trustee appointed hereunder by an instrument recorded in the counry <br />in which this Security Instrument is recorded. Without conveyance of the Property, the successor trustee <br />shall succeed to all the title, power and duties conferred upon Trustee herein and by Applicable Law. <br />25. Request for Notices.
