<br />WHEREAS, the within named Grantor is the Trustee under the terms of a certain
<br />Construction i�eeci of "I�rust dated September 1, 'LU06, and fileci of record in the office of the
<br />Register of Deeds of Hall County, Nebraska, on September 14, 2006, as Instrument No.
<br />0200608237, wherein Grand Island Nebraska Associates, L.L.C., a Michigan Limited Liability
<br />Company, was identified as the Trustor;
<br />WHEREAS, said Trustee has, upon default of the Trustor of the obligations contained in
<br />such Deed of Trust, caused Notice of Default and Notice of Sale to be filed, given, and published
<br />as required by Chapter 76, Article 10, of the Nebraska Trust Deeds Act;
<br />WHEREAS, a public sale of the real estate hereinafter described was conducted on the
<br />date and at the time and place designated in the Notice of Sale; and
<br />WHEREAS, the within named Grantee offered the highest bid at such public auction,
<br />NOW, THEREFORE, EQUITABLE BANK, Trustee under a certain Construction Deed
<br />of Trust dated September 1, 2006, and filed of record in the office of the Register of Deeds of
<br />Hall County, Nebraska, on September 14, 2006, as Instrument No. 0200608237; herein called
<br />the Grantor, for and in consideration of the sum of Three Hundred Thousand and No/100 Dollars
<br />($300,000.00), as credit against the indebtedness secured by such Construction Deed of Trust,
<br />received from Grantee as holder of the beneficial interest in such Construction Deed of Trust,
<br />does hereby quitclaim, grant, bargain, sell, convey, and confirm unto EQUITABLE BANK,
<br />herein called the Grantee, the following-described real estate in Hall County, Nebraska:
<br />Lot Four (4), Block One (1), Wal-Mart South Subdivision to the City of Grand Island,
<br />Hall County, Nebraska.
<br />TO HAVE AND TO HOLD the premises above described, together with all the
<br />buildings, improvements, hereditaments, and appurtenances thereunto belonging, unto the said
<br />Grantee and to Grantee's heirs, successors, and assigns forever.
