201100649 4. Building Height. Sections 3(B)(2) and 3(B)(4) of the Agreement are herebyrevised to provide that the 5,000 square foot restaurant building to be constructed on the Buffalo Wild Wings Parcel shall not exceed twenty four (24) feet in height as measured from the ground floor elevation, with an additional five (5) feet of architectural elements above the general roofline, with a total aggregate width of such element along any single roofline of no more than (i) twenty five percent (25%) of the length of the roofline on the west and east elevation; and (ii) twenty percent (20%) of the length of the roofline on the north and south elevation, for a total of twenty nine (29) feet in height as measured from the ground floor elevation. 5. Ratification. Except as specifically set forth in this Amendment, all terms and conditions in the Agreement shall remain in full force and effect. 6. Counterparts. This Amendment may be executed in any number of counterparts, all of which taken together shall constitute one and the same instrument, and any of the parties hereto may execute this Amendment by signing any such counterpart.
