201100649 <br />4. Building Height. Sections 3(B)(2) and 3(B)(4) of the Agreement are herebyrevised <br />to provide that the 5,000 square foot restaurant building to be constructed on the Buffalo Wild Wings <br />Parcel shall not exceed twenty four (24) feet in height as measured from the ground floor elevation, <br />with an additional five (5) feet of architectural elements above the general roofline, with a total <br />aggregate width of such element along any single roofline of no more than (i) twenty five percent <br />(25%) of the length of the roofline on the west and east elevation; and (ii) twenty percent (20%) of <br />the length of the roofline on the north and south elevation, for a total of twenty nine (29) feet in <br />height as measured from the ground floor elevation. <br />5. Ratification. Except as specifically set forth in this Amendment, all terms and <br />conditions in the Agreement shall remain in full force and effect. <br />6. Counterparts. This Amendment may be executed in any number of counterparts, all <br />of which taken together shall constitute one and the same instrument, and any of the parties hereto <br />may execute this Amendment by signing any such counterpart. <br />AT WITNESS WHEREOF, the parties hereto have caused this Amendment to be executed as <br />of the date above first written. <br />The remainder of this page is intentionally blank. <br />
