2 011Q0648 <br />4. Alcohol Restriction. Section 3(xiv) is hereby amended to provide as follows solely <br />to the Buffalo Wild Wings Parcel: <br />(xiv) any bar, tavern, restaurant, ar other establishment whose reasonably <br />projected annual gross revenues from the sale of alcoholic beverages for on-premises <br />consumption exceeds forty percent (40%) of the gross revenues of such business; <br />5. Ratification. Except as specifically set forth in this Amendment, all terms and <br />conditions in the Declaration shall remain in full force and effect. <br />6. Counterparts. This Amendment maybe executed in anynumber of counterparts, all <br />of which taken together shall constitute one and the same instrument, and any of the parties hereto <br />may execute this Amendment by signing any such counterpart. <br />IN WITNESS WHEREOF, the parties hereto have caused this Amendment to be executed as <br />of the date above first written. <br />The remainder of this page is intentionally blank. <br />
