L�J <br />THIS ASSIGNMENT OF NOTE AND TRUST DEEDS ( "Assignment "), dated <br />December 9 , 2010, is made by Mosaic, a Nebraska nonprofit corporation ( "Borrower "), whose <br />address is 4980 South 118' Street, Omaha, Nebraska 58137 -2220 in favor of American National <br />Bank ( "Lender "), whose address is 8990 West Dodge Road, Omaha, Nebraska 68114 -3383. <br />R P. r -ital c <br />1. Borrower executed and delivered to Lender a promissory note ( "Mosaic Note ") in <br />the principal sum of Four Hundred Fifty Thousand Dollars (450,000.00) dated December , 2010. <br />2. In turn Borrower loaned the proceeds thereof to Mosaic Residential Services of <br />Nebraska, LLC, a Nebraska limited liability company ( "Owner ") executed a Promissory Note dated <br />December 9, 2010, in the principal sum of $450,000 payable to Borrower ( "Note "). <br />3. Borrower now desires to assign the Note and Trust Deeds to Lender to secure <br />repayment of the Mosaic Note given by Borrower to Lender. <br />Assignment <br />FOR GOOD AND VALUABLE CONSIDERATION, the receipt and sufficiency of which <br />are hereby acknowledged, Borrower, subject to the limitation set forth below, hereby grants, <br />bargains, sells, conveys, assigns, transfers and sets over unto Lender all of Borrower's rights in the <br />Note and the Trust Deeds, together with all monies now owing or that may hereafter become due or <br />owing with respect thereto and the full benefit of all the powers and all the covenants and <br />provisions therein contained and all assignable rights of Borrower in and to any and all title <br />insurance policies insuring the lien of the Trust Deeds.
