za�lon��o <br />(q) "Loan Documents" means thc Nate, this Instrument, all guaranties, all indemnity <br />agreements, all Collateral Agreements, O&M �'cograms, and any ather documents now or in the <br />future executed by Borrower, Key Principal, any guarantor or any other persvn in connectian with <br />the laan evidenced by the Note, as such documents may be amended fram time to time. <br />(r) "Loan Serviccr" means the entity that from time to time is designated by Lender to <br />collect payments and depasits and rec�ive notices urider the Nate, this Instrument and any other <br />Loan Document, and otherwise to service the laan evidenced by the Note fnr the bene�t af Lender. <br />Unless Borrower receives notice to the contrary, the Laan Servicer is the entity identified as <br />"Lender" in the first paragraph of this Instrum�nt. <br />(s} "Mortgaged Property" means all of $orrower's present and future right, title and <br />interest in and to all of the follawing: <br />(1) the Land; <br />(2) the Improvements; <br />(3} the Fixtwes; <br />(4) the Personalty; <br />(5) all current and future rights, including air ri�hts, development rights, zonin� <br />rights and other similar ri�hts or interests, easements, tenements, <br />rights-af way, strips and gores of land, streets, alleys, raads, sewer rights, <br />waters, watercourses, and appurtenances related to or benefitting the Land ar <br />the Ymprovements, or both, �nd all ri�hts-of-way, streets, alleys and raads <br />which may have been or may in the future be vacated; <br />(6) all proceeds paid or to b� paid by any insurer of the Land, the Improvements, <br />the Fixtures, the Persanalty or any other part of the Mort�aged Property, <br />whether or not Borrower obtained the insurance pursuant to Lender's <br />requirement; <br />(7) all awards, payrnents and other compensation made or to be made b� any <br />municipal, state or federal authority with respect to the Land, the <br />Improvements, the Frxtures, the Persanalty ar any other part a#` the <br />Mortgagcd Properly, including any awards or settlements resulting from <br />condemnation proceedings or the total or partial taking of the Land, the <br />lmprovements, the Fixtures, the Fersonalty or any other part of the <br />Martga�ed Property under the power of eminent domain or otherwisc and <br />including any epnvey�nce in lieu thereaf; <br />FAN'NT� MAE MULTiFAMiLY SECURTTY INSTRUMEI�TT - Form 4028 06/09 Page 4 <br />N�BRASKA <br />(� 1997-Z009 Pannie Mac <br />
