201100260 <br />(b) "Collateral Agreement" means a.ny s�pa� agreement between Borrower and <br />Lend�r far the purpose o£ establishing replacement reserves for the Mortgaged Property, <br />establishing a fund to assure campletion of repairs or impxovements speci�ed in that agreement, <br />or assuring reduction of the autstanding principal balance of the Indebtedness if the occupancy of <br />or income from the Mart�aged Property d�es not increase to a level specired in that agreement, <br />or any other agreement or agreements between Borrower and I.ender which provide for the <br />establishment of any other fund, reserve or account, <br />(c) "Environ�nental Permit" mcans any permit, license, or other autharizatian issued <br />under any Hazardous Materials Law with respect to any activities or businesses conducted on or <br />in relation to the Martgaged Praperty. <br />(d) "Event of Default" means the occurrence af any event listed in Section 22. <br />(e) "Fixtures" means all praperty which is so attached to th� Land ar the <br />Impravements as ta constitute a fixture under applicable law, including: machinery, equi�ment, <br />engines, boilers, incineratdrs, installed building materi�ls; systems and equipment far the purpo5� <br />of supplying ar distributing heating, cooling, electricity, gas, water, air, ar light; antennas, cable, <br />wiring and conduits used in connection with radio, television, security, fire prevention, or fire <br />detection or otherwise used ta carry electronic signals; telephone systems and equipment; <br />elevators and related machinery and equipment; fire d�tection, prevention and extinguishing <br />systems and ap�aratus; security and access control systems and appazatus; plumbing systems; <br />water laeaters, ranges, stoves, microwave ovens, refrigerators, dishw�shers, garbage disposers, <br />washers, dryers and oth�r appliances; light fixtures, awnings, storm windaws and storm doors; <br />pictures, screens, blinds, shades, curtains and curtain rods; mirrors; cabinets, paneling, rugs and <br />floor and wall coverings; fences, trees and plants; swimming poals; and exercise equipment. <br />(� "Governmental Authority" m�ans any board, commission, department or body o�' <br />any municipal, aounty, state or federal governmental unit, or any subdivision of any af them, that <br />has or acquires jurisdiction over the Martgaged Property or th� use, operation pr improvement of <br />the Mortgaged Property. <br />(�) "Ha�ardous Materials" means petroleum a�nd penvleum products and campounds <br />containing them, including gasaline, diesel fuel and oil; explosives; flammable materials; <br />radioactive materials; polychlorinated biphenyls ("FCBs") and compounds cantaining them; lead <br />and lead-based paint; asbestos ar asbestos-containing materials in any form that is or could 6ecome <br />friable; underground or above-ground starage tanks, wh�ther empty or cantaining any substance; <br />any substance the presence of which an the Martgaged Fraperty is prohibited by any federal, state <br />vr local authority; any substance that requires special handling; and any other material or substance <br />now ar in the future defined as a"hazardous substance," "hazardous material," "ha�ardous waste," <br />"tpX1C substance," '�tOXIC p01�U�ilt,�� "contaminant," OI' '�p011lital]t'� W1�1111 �'18 meaning of any <br />Hazardous Materials C,,aw. <br />FANNIE MAE MUC�TIFAMILY SECURITY INSTRUMENT - Form 40Z8 06/09 Page Z <br />NEBRASKA <br />&� 1997•2009 i'annic Mac <br />
