201100260 <br />(2) to the best of Bortawer's knowledge after reasonable and diligent inquiry, na <br />Prohibited Activities or Conditions exist or havc �xisted; <br />(3) except to the extent previously disclosed by Bonower to L�nder in wtiting, <br />the Martgaged Property does not now contain any underground storage <br />tanks, and, to the best af Borrower's knowledgc after reasonable and diligent <br />inquiry, the Mortgaged Praperty has not contained any underground storage <br />tanlcs in the past. If there is an underground storage tank locat�d on the <br />Property which has been previously disclased by Borrower to Lender in <br />writing, that tank complies with all requirements of Hazardaus Materials <br />Laws; <br />(4) Sarrower has complied with all Hazardous Materials Laws, including all <br />requirements for notification r�garding releases of Hazardous Materials. <br />Without limiting the generality of the foregoing, Barrawer has obtained all <br />Enviranmental Perrnits required for the operation of the Mortgaged Prnperty <br />in accardance with Ha7ardous Materials Laws now in effect and all such <br />Enviranrnental Permits arc in full force and effect; <br />(5) no event has accurred with respect ta the Mortgag�d Praperty that <br />constitutes, or with the passing of time or the giving af notice would <br />canstitute, noncompliance with the terms of any �nvironnacntal Permit; <br />(6) there are na actions, suits, claims or praa��dings pending or, ta the best of <br />Borrow�r's knawledge after reasonable and diligent inquiry, threatened that <br />invalve the Mortgaged Property and allege, arise out of, or relate to any <br />Prohibited Activity or Conditian; and <br />(7) Borrowcr has nat received any complaint, order, notice of violation or other <br />communicatian fram any Governmental Autharity with regard to air <br />emissions, water dischazges, noise emissions or Hazardous Materials, or any <br />other environmental, health or safety matters affecting the Mortgaged <br />Pxoperty or any ather prop�rty pf Bprrpwer that is a,djacent to the Mortgaged <br />Property. <br />The representatians and warranties in this Section 18 shall be cantinuing representations and <br />warranties that shall be deemed to be made by Bortower thraughout the term of the laan e�videnced <br />by the Note, until the Indebtedness has been paid in full. <br />(f� Borrower shall pramptly notiFy Lender in writing upon the occurrence of any of the <br />fvllowing events: <br />(1) Borrowcr's discavery of any Prohibited Activity ar Condition; <br />FANNTE MAE MULTIFAMILY SECURITY INSTRUMENT - �'orm �t028 06/09 f age 20 <br />NEBRASKA <br />� 1997-2009 Fannic Mac <br />
