201100260 (2) to the best of Bortawer's knowledge after reasonable and diligent inquiry, na Prohibited Activities or Conditions exist or havc �xisted; (3) except to the extent previously disclosed by Bonower to L�nder in wtiting, the Martgaged Property does not now contain any underground storage tanks, and, to the best af Borrower's knowledgc after reasonable and diligent inquiry, the Mortgaged Praperty has not contained any underground storage tanlcs in the past. If there is an underground storage tank locat�d on the Property which has been previously disclased by Borrower to Lender in writing, that tank complies with all requirements of Hazardaus Materials Laws; (4) Sarrower has complied with all Hazardous Materials Laws, including all requirements for notification r�garding releases of Hazardous Materials. Without limiting the generality of the foregoing, Barrawer has obtained all Enviranmental Perrnits required for the operation of the Mortgaged Prnperty in accardance with Ha7ardous Materials Laws now in effect and all such Enviranrnental Permits arc in full force and effect; (5) no event has accurred with respect ta the Mortgag�d Praperty that constitutes, or with the passing of time or the giving af notice would canstitute, noncompliance with the terms of any �nvironnacntal Permit; (6) there are na actions, suits, claims or praa��dings pending or, ta the best of Borrow�r's knawledge after reasonable and diligent inquiry, threatened that invalve the Mortgaged Property and allege, arise out of, or relate to any Prohibited Activity or Conditian; and (7) Borrowcr has nat received any complaint, order, notice of violation or other communicatian fram any Governmental Autharity with regard to air emissions, water dischazges, noise emissions or Hazardous Materials, or any other environmental, health or safety matters affecting the Mortgaged Pxoperty or any ather prop�rty pf Bprrpwer that is a,djacent to the Mortgaged Property. The representatians and warranties in this Section 18 shall be cantinuing representations and warranties that shall be deemed to be made by Bortower thraughout the term of the laan e�videnced by the Note, until the Indebtedness has been paid in full.
