Lender may pay <br />an Irnposition according to any bill, statement or estimate fram the apprapriate public office or <br />insurar�ce campany without inquiring inta the accuracy of the bill, statement nr estimate or inta the <br />validity of the Imposition. <br />(d) If at any timc the amount of the lmposition I)eposits hcld by Lender For payment of <br />a specific Imposition exce�ds the amouni reasonably deemed necessary by Lcnder, the excess shall <br />be credited against future installments of Imposition Deposits. Tf at any time the amount af the <br />]mpositian Deposits held by Lender for payment of a specific Impasition is less ihan the amaunt <br />reasonably estimated by Lender ta be neeessary, Borrower shall pay to Lender the aznount of the <br />deficiency within 15 days after notice from Lender. <br />(e) !f an Event of Default has occurred and is continuing, Lender may apply any <br />Imposition Deposits, in any amownts and in any order as Lender determines, in Lender's discretion, <br />to pay any Impositions or as a credit �gainst the Indebtedness. Upon payment in full of th� <br />Indebtedness, Lender shall refund to Borrower any Imposition Deposits held by Lender. <br />$, COLLATERAL AGREEMENTS. <br />Borrower shall deposit with Lender such amaunts as may be required by any Collateral <br />Agreement and shall perforna all ather obligations of $orrawer under each Collateral Agreem�nt. <br />9. APPLICATION OF PAYMFNTS. <br />Tf at any time Lender receives, from Borrower or otherwise, any amount applicable to the <br />Indebtedness which is less thari all amounts due and payabl� at such time, then Lender may apply <br />that payrnent to amounts then due and payable in any manner and in any order determined by <br />Lender, in Lender's discretian. Neith�r Lender's acceptance of an amount which is less than all <br />amaunts then due and payable nor Lender's application of such payment in the manner authorized <br />shall constitute or be deemed to constitute either a waiver af the unpaid amounts or an accord and <br />satisfactian. Notwithstanding the applicatian of any such amount to the Indebtedness, Borrower's <br />abligations under this lnstrument and the Note shall remain unchanged. <br />10. C�MPLIANCE WITH LAWS. <br />Borrawer shall comply with all laws, ordinanccs, r�gulations and requirements af any <br />Govemmental Authority and all recordcd lawFul covenants and agreements relating ta or affecting <br />the Mortgaged Property, including all laws, ordinanc�s, r�gulations, rEquirEmcnts and covenants <br />pertaining to health and safety, canstruction of improvements on the Mortgaged �'roperty, fair <br />housing, zoning and land usc, and Leases. Borrower also shall camply with all applicable laws.that <br />pertain to the maintenance and dispasitian of tenant secw deposits.
