�o�ioo�s� <br />Property is located and shall mail copies of such notice in the manner prescribed by applicable law to Sorrower <br />and to the other persons prescribed by applicable law. After the time reqnired by applicable law, Trustee shall <br />give public notice of sale to the persons and in the manner prescribed by applicable taw. Trustee, without <br />demand on Barrower, shall sell the Property at public auction ta the hi�hest bidder at the time and place and <br />under the terms designated in the notice of sale in one or more parcels and in any order Trustee determines. <br />Trustee may postpone sale of all or any parcel af the Property by public announcement at the time and place of <br />any previously scheduled sale. Lender or its designee may purchase the Property at any sale. <br />Upon receipt of payment of the price bid, Trustee shall deliver to the purchaser Trustce's deed conveying the <br />Property. '�'hc reeitals in the Trustee's deed shall be prima facie evidence nf the truth of the statements made <br />therein. Trustee shall apply the prpceeds of the sale in the foilowing order: (a) to all costs and expenses of <br />exercising the power of sale, and the sale, including the payment af the Trustees fees actually incurred and <br />reasonable attorneys' fees as permitted by applicable law; (b) to all sums secured by this Security Instrument; <br />and (c) any excess to the person or persons legally entitled to it. <br />21. Lien Priority. The full amnunt securcd by this Security Instrument shall have the same priority over any <br />other liens on the Property as if the fu11 amount had been disbursed on the date the initial disbursement was madc, <br />regardless of the actual date of any disbursement. The amount secured by this Security Instnunent shall include all <br />direct payments by Lender to Borrpwcr and all other loan advances permitted by this Security Instrument for any <br />purpose. This lien priority shall apply nptwithstanding any State constitution, law or re�,=ulatipn, except that this lien <br />priority shall not affect the priority of any liens for unpaid Statc or lacal governmental unit special assessments pr taaces. <br />22. Reconveyance. Upon payment of all surns secured by this Security Inshument, Lender shall request Trustee to <br />reconvey thc Property and shall surrender this Security Instrumcnt and all notes evidencing debt secured by this <br />Security Instrument to "frustee. Trustce shall reconvey the Property without warranty to the person or persons legally <br />entitled to it. Such person or persons shall pay any recordation costs. Lender may charge such person or persons a fee <br />for reconveying the Property, but only if thc fcc is paid to a third party (such as the Trustcc) for services rendered and <br />the chaa of the fee is permitted under applicable law. <br />23. Substitute Trustee. Lender, at its aption, may from time to time remove Trustee and appoint a successor trustee <br />ta any Trustec appointed hereunder by an instrumr.•nt recordcd in the county in which this Security Instr�unent is <br />recorded. Without conveyance of the Praperty, the successor trustee shall succeed to all thc title, power and duties <br />cnnferrcd upon Trustee herein and by applicable law. <br />24. Request for Notices. Borrower requests that copics of the notice of default aiid sale be sent to Bprrower's address <br />which is the Property Address. <br />25. Obligatory Loan Advances. Lender's responsibility to make Loan Advances under thc tcrms af the Loan <br />Agreement, including Loan Advances of principal to Borrower as wcll as Loan Advances for interest, MIP, Servicing <br />Fees, and other charges shall be obligatory. <br />26.
