<br />WILLIAM A. FRANCIS, A Member of the Nebraska State Bar Association, as TRUSTEE, and
<br />DAVID J. WETHERILT, A Single Person, referred to as BENEFiCIARY.

<br />7"�at TRUSTORS hereby grant, bargain, sell, convey and warrant to TRUSTEE, IN
<br />TRUST, his successors and assigns, with power of sale, the following-described real property:

<br />of Grand Island, Ha11 County, Nebraska
<br />together with all buildings, impravernents and appurtenan.ces thereon.
<br />The TRUSTORS hereby covenant and a�ree with tla�e TRUSTEE and BENEFICIARY t11at
<br />TRUSTORS are lawi'ully seized and the owilers of the above-described property; that they have
<br />goad ri�;ht and lawful ri�ht and authority to sell and convey said premises and that said premises are
<br />free and clear of liens and enctunbrances except only insofar as a current outstanding Deed of Trust
<br />executed by BENEI'ICIARY in favar of Exchange Bank, TUSTORS will warrant and deiend the
<br />title to said premises farever against the claims �f all persans whomsoever except as lirnited herein,
<br />For the purpose of securing performance of each agreement of TRUSTOR herein contained
<br />and the payment of SEVENT�THREE THOUSAND FOUR HLTNDRED DOLLAR� ($73,400.00),
<br />the TRUSTORS have executed a Promissary Nate bearin� even date, at the rate of interest arzd oz�.
<br />the terms and conditions as set forth in such Note until paid. The principal siun and interest shall be
<br />payable in accordance with and upon the tenns and conditions of said Note of even datc, and in any
<br />event the entire principal balance due hereunder and any accrued interest shall be paid on January 1,
<br />2026. All installment payments hereunder shall be applied lirst to the payment of interest
<br />computed monthly on t11e unpaid balance, pursua�t to the Amortization Schedule, a copy of which
<br />has been provided to each of the parties hereto, and rerza.ainder of each payment af each installment
<br />ta be applied to principal. All payments due her�under shall be paid at the residence of the
<br />BENEFICIARY or as the holder of said security shall desi�nate in writing.
<br />It is agreed by and betwe�n the parties hereto that while title is vested in the TRUSTEE and
<br />until filing of Notice of Default, the TRUSTOR shall:

<br />Retain possession of the property at all times, except as may be otherwise agreed by tlae
<br />parties in writing.
<br />Maintain the building and its improvements and all personal property sold ui�der the
<br />parties' Contract for Sale of Real Estate, in good condition and repair.
<br />Pay all general and special taxes and all special assessments of every kind levied or
<br />assessed against or du� upon said property before deliiaquency, and ta deliver to
<br />BENEFICIARY copies of receipts shawing payment of such taxes.
<br />Procure and maintain policies of all-risk insurance on said improvements, in sums a��d
<br />underwritten by companies acceptable to the BENEFICIAI�Y, in an amount of at least
<br />SEVENTY-THREE THOUSAND FOUR HUNDRED Dollars ($73,400.00.00), which
<br />policies shall name the BENEI'ICIARY and Exchai��;e Bank as additional insured(s), with
<br />the loss proceeds payable to the parties as their interests n�ay appear hereunder.
<br />TRUSTORS agree to provide BENEFICIARY with copies of such policies or certiticates
<br />af insurance during the term of this indebtedz�ess, which policies of insurance may not be
<br />cancelled by said carrier without �fteen (1S) days written notice to BENEFICIARY.
