<br />WITNESSETH, Tha� the Trustor, �or good and valuable consideratian,
<br />includin.g the debt and trust hereinafter menta.oned and crea�ed, an.d the sum
<br />of one dollar to Trustor paid by the said Trustee, the receipt and suffi-
<br />ciency o� which is hereby acknowledged, does by these pr�sents, irrevocably
<br />grant, bargain and sell, canvey, assign and confirm unto �he said Trustee, IN
<br />TRUST, WITH POWER OF SALE, for �.he ben�fit and security at Beneficiary, under
<br />and subject to the terms and conditions of this Deed of Trust, the following
<br />described real property situa�ed in Hall County, Nebraska, to-wit:
<br />Unit Twenty (20), Oakwood Condominiums, City of Grand Island, Hall
<br />County, Nebraska.
<br />TOGETHER with and including all and singular the �.enements, heredi�.a-
<br />men�s, appurtenances and privileges thereunta belanging or in anywise
<br />appertaining, wh��.her n.ow or hereafter acquired, which shall include, withaut
<br />limiting the gen.erality of the foregoing, �.he following:
<br />All of the rents, issues and profits, including a11 ren�.s, �oyal�.ies,
<br />bonuses and be�efi�.s un.der any existing or fu�ure oil, gas or min.eral or
<br />ather l.eases; a1.1 �asements and rights of way, all rights o� homestead
<br />and hom�stead exemp�.ion and any surviving spouse's marital or dis�ribu-
<br />tive share, and all other cantingent rights in and to said premises; and
<br />A11 fix�ures, imp�ovemen�s, buildings, and the plumbing, heating,
<br />ventila�ing and lighting systems and equipment ther�in, all of which
<br />shall be construed and considered as aftixed to and part ot the real
<br />esta�e.
<br />A11. of the foregoing esta�.e, property and interes�. he�eby canveyed �.o the
<br />said Trustee is hereinaf�er collectively referred to as the ��Proper�.y.��
<br />TO HAVE AND TO HOLD �.he same unto the said Trus�ee, Trustee' s successors
<br />and assigns forever, IN TRUST HOWEVER and WITH POWER OF SALE hereby expressly
<br />granted unto the said Trustee, Trustee's successors, and assigns for the
<br />purpose of securing:
<br />(a) The payment of Trustor's just indebtedness to Beneficiary in the
<br />principal sum of One Hundred Sixty Thousand Dollars ($�60,OOp.00) for maney
<br />borraw�d, with interest tihereon, all as �videnced by and in s�.rict accordance
<br />with th� terms of that cer�ain promissory note herein.after called the '�Nate" ,
<br />bearing even dat� herewith made payable to �he order of Beneficiary, executed
<br />by Terry ,7ennings, and praviding for the payment ot said indebtedness in
<br />ins�.allments, subjec� to acceleratian of ma�.urity on default in the paymen.t
<br />of any installmen�. of principal or interes�. or in the performance of any
<br />covenant, agreemen�. or warranty con�ained in this Deed af Trust;
<br />(b) Th� perfor►nance of each agreement, covenant and warranty af Trustar
<br />herein contained or se� forth in th� Note or any agreement ar instrument
<br />execut�d by Trustor in connecti�n with the indebtedness hereby secured; and
<br />(c) The payment of any sum ar sums af money with interest thereon which
<br />may be hereafter paid or advanced under �he terms of this Daed o� Trusr.
