<br />Carline A. Denman, being first duly sworn upon his or her oath, deposes and says:
<br />1. That the Af�iant is the successor trustee under the terms and conditions of the Elvin
<br />R. Denman Revocable Trust dated January 21, 1997 (hereinafter referred to as the "said Trust").
<br />2. That on December 2, 2009, the AflYant became the successor trustee ofthe said Trust
<br />following the death of Elvin R. Denman on Navember 23, 2009, the settlor and initial trustee af said
<br />Trust, a certified copy of his death certificate is attached as Exhibit "A", and upon signing an
<br />Acceptance ta Act as Trustee under the Elvin R. Denman Revocabl� Trust, an ariginal af which is
<br />attached as Exhibit "B ".
<br />That the Affiant remains the sale trustee of the said Trust as of this date.
<br />4. That among the assets of the said Trust is the following described real property that
<br />was conveyed to the trustee of th� said Trust on February 12, 1997, by Wananty Deed recorded on
<br />�'ebruary 13, 1997, in the recards of the Hall County Register of Deeds Office as Document No. 97-
<br />100993:
<br />An undivided one-half (yz) interest in and to the Northwest Quarter of the
<br />Northwest Quarter (NWl/4NW'/�); the West Half of the West Half of the
<br />Southwest Quarter (W'/xWl/zSWI/.) to the Platte River also known as Lot Four
<br />(4) an� tt�� West Half o#' the �outlawest Q�a�rt�x Q+F the Northvt�est Q�s��•t�r
<br />(WyzSW'/aNWI/a) all in Section �eventeen (17), Township Ten (10), Range Nine
<br />(9) West of the bth P.M., Hall County, Nebraska; EXCEPTING a tract oC land
<br />containing two (2) acres, mare particularly described as being 18 rods by 18
<br />rods, located in the Southeast corner ot'the Northwest Qnarter of the Northwest
<br />Quarter (NW'/.NW'/a) in said Section Seventeen (17); EXCEPTING Lot One
<br />(1), Fireside Interstate Plaza Subdivision, Hall County, Nebraska; EXCEPTTNG
<br />Lot One (1), Fireside Interstate Plaza Secand Subdivision, Hall County,
<br />Nebrastta; and EXCEPTING all land deeded to the State of Nebraska for
<br />highway purposes; and
<br />An undivided one-half ('/z) interest in and ta the West Two-thirds (2/3) of Lot
<br />Five (5), of Roeser's Subdivision of the South Half of the Northwest Quarter
<br />(S��NW'/o) of Section Siateen (16), Township Ten (10) Nortlr, Range Niae (9)
<br />West of the 6th P.M., Hall County, Nebraska.
<br />S. That pursuant to the terms ofthe said Trust and §30-3 881(2) ofthe Nebraska Uniform
<br />Trust Cade, the trustee of the said Trust has the power, without court authorization, to acquire or
<br />sell property, for cash or on credit, at public or private sale.
<br />6. That neither the said Trust or the trust instrument creatin� the said Trust, nor any part
<br />thereof, has been revoked, amended, or terminated, and the above statements canstitute a full
