2Q1008d41 <br />THIS AGREEM�NT (thc "AgrccmBnt"), affective as of the Effective Date above, is made by and among the <br />Subordinating Lender, Ownars and the Senior Lender named above. <br />MELV1N J SC�IlVIIT AND PATRICIA A SCHIvIIT, HUSBAND AND WTFE, AS JOINT TENANTS WITH <br />RIGHT OF SURVNORSHIP� AND NOT AS TENANTS IN COMMON (individually and collcctively the <br />"Owner") awn the real property located at the abave Pmperty Address (the "Pz�aperty"). <br />The Subordinating Lender has an interost in the Prpperty by virtue of a Real Estate Deed Of Trust (With Futurc <br />Advance Clause) given by the Owner, covering that real property, more particularly described a� follows: <br />Seo Exhibit A <br />R„�ord�l ��9-���f <br />which document is dated the 20th day of July, 2004, which was �led in Document ID# 2004�7810 at paga N/A (or <br />as No. N/A) of the Racocds of the Office of the Registcr af Deeds of the Gounty of HALL, State of Nebraska (the <br />"Existing 5ecurity Instrument"). The Existing Security Instrument secures repayment of a debt evidenced by a note <br />or a line of credit e�grcement extended to PATRICIA A SCHMIT and MELVIN J SCHMIT (individually and <br />callectively "Sorrowe�') by the Subnrdinating Lendec. <br />t�0G0� on 11���t0 L�IS ln�•� 20�044a20b <br />'The Senior Londer has a$reed to make a now laan or amend an axisting loan in the original principal amnunt NOT <br />to exceed $a 1,212.Od "New Loan or Amended Loan"), providcd that th� New Loan or Amended Loan is <br />secured by a first lien martgage an the Pmperty (thc "Ncw Security Instrument") in favor of the S�tuor Lender. Agreemeat to Subordinate <br />Subordinating Lender and Trustee, if applicable, hereby subordinatas the lien of the ExisUng Security <br />Instrument, and all of its modifications, extensions und renewals, to the lien of the New Security Instrument. <br />This Agreement is cffective as to any sum whose repayment is presently secured or which may in the future be <br />secured by the Existing Security Instrument. <br />B. Appointment of Substitute Truatce IfApp[tcable <br />The Existing Security Instrument namcs N/A, as Trustoe and the 5ubordinating Lender as Beneficiary. The <br />Existing Security Instrument provides that the Subordinating Lender may designate and appoint a subsdtute <br />Trustee in place of any other trustao by an instrument recorded emong the appropriata land rocords. <br />The Subordinating Lendor hereby removes N/A as Trustme and designates aad appoints N/A as substitute <br />Trustae with the same powers and duties as were odginally vestcd in thc Original Trustee under tha Existing <br />Security Instrument. <br />C.
