<br />The undersigned, Equitable Barik, Trustee under a certain Construction Deed of Trust r�
<br />dated September l, 2006, wherein Grand Island Nebraska Associates, L.I,.C., a Michigan �'-�
<br />Limited Liability Campany, is the Trustor, which was filed for record in the office of the
<br />Register of Deeds af Hall County, Nebraska, on Septe�nber 14, 2006, as Instrument No.
<br />0200608237; a�nd cantains as trust property the following-described real estate:
<br />Lot Four (4), Block Qne (1), Wal-Mart South Subdivision to the City of Grand
<br />Island, Hall County, Nebraska;
<br />which is commanly known as 35�9 S. Locust Street, Grand Island, Nebraska;
<br />together with all existing or subsequently erected or affixed buildings, improvements and
<br />fixtures; all eas�ments, rights of way, and appurtenances; all water, water rights and ditch rights
<br />(including stock in utilities with ditch or irrigation rights); and all other rights, rayalties, and
<br />profits relating to the real property, including without limitation all minerals, oil, �as, geothermal
<br />and sirnilar matters, all of which was r�ferred to in such Const� Deed of Trust as the "Real
<br />Property";
<br />hereby gives natice of default af said Trustar far the reason that said Trustor has failed to make
<br />the payments of principal and interest due in respect to the Promissory Note secured by that
<br />Construction Deed of Trust.
<br />By reason of such default, the undersigned Trustee hereby elects to sell or cause to be
<br />sold the above Real Froperty to satisfy the obligatians of that certain Promissary Note dated
<br />September 25, 200$, owing from Trustor ta the Beneficiary, EQUITABLE BANK, pursuant to
<br />the terms af the Construction Deed af Trust referred to above, which secures this obligation.
