201008471 <br />BORROW�R, in consideratian of the indebtedness herein recited and the trust herein created, <br />irrevocably grants and c�nveys to Trustee, in trust, with power of sale, the following described property <br />located in the County of Hall , State of Nebraska: <br />Lots On� Hundred Twenty (120) and One Hundred Twenty One (121), Belmont Addition ta the City of <br />Grand Island, Hall County, Nebraska <br />'This is a purchase money beed of 7rust." <br />which has the address of 505 N. Grace Avenue, Grand Island, NE 68803 <br />(herein "Praperty Address"); <br />TQGETHER with all the improvements now, or hereafter erected on the property, and all <br />easements, rights, appurtenances, rents, (subject however to the rights and auth�rities given herein to <br />Lender to collect and apply such rents), all of which shall be deemed to be and rem�in a part of the <br />pr�perty covered by this Deed of Trust; and all of the foregoing, together with said property (or the <br />leasehold estate if this Deed of Trust is on a leasehold) are hereinafter referred to as the "Praperty". <br />Borrower covenants that Barrower is lawfully seised of the estate hereby conveyed and has #he <br />right to mortgage, grant and convey the Praperty and that the Property is unencumbered, except for the <br />First Deed of Trust identified in paragraph 23 (hereinafter referred as the "First Deed of 1'rust") <br />encumbrances of record. Borrower covenants that Borrower warrants and will defend generally the title <br />to the Property against all claims and demands, subject ta any encumbrances of record. <br />UNIFORM COV�NANTS. Borrower and Lender covenant and agree as follaws: <br />1. Payment af Principal; Prepayment. Borrower shall promptly pay when due the principal of the <br />debt evidenced by the Note. <br />2. Appllcatlon of Payments. Unless applicable law provides otherwise, all payments received by <br />Lender underthe Note and paragraph 1 hereof shall be applied by Lender first to any payments made by <br />Lender pursuantto paragraph 6; and second, to principal due underthe Note. <br />3. Priar Mortgages and Deeds of Trust; Charges: Liens. Borrower shall perform all of <br />Borrowers obligations under any mortgage, deed of trust or other security agreement with a lien which <br />has priority over this Deed of Trust, including Borrower's covenants to make payments when due. <br />Borrower shall pay or cause to be paid all taxes, assessments and other charges, fines, and impositions <br />attributable to the Property, which may attain a priority over this Deed of Trust, and leaseh�ld payments <br />or ground rents, if any. Borrower shall pay these obligations by making payment, when due, directly ta <br />the perspn owed payment. Borrower shall promptly furnish to Lender all notices of amounts due under <br />this paragraph, and receipts evidencing such payments. <br />Except for the First Deed of Trust Identlfled ln paragraph 23 (hereinafter referred as the "First Deed of Trust") <br />Barrpwer shall promptly discharge any lien which has priority over this Deed of Trust unless Borrower: (a) <br />agrees in writing to the payment of the obligation secured by such lien in a manner acceptable to Lender; <br />NE �ntry CostAsslstance Loan Daed of Trust 2200088229 Page 2 of 8 <br />0204 (ECAMNE) <br />
