C/> <br />� <br />� � <br />rv m <br />r� v <br />� � <br />c.a Z <br />� � <br />C� C <br />� m <br />C:7"7 � <br />� � <br />� <br />This Subordination Agreement, hereinafter the "Agreement", is made and entered into on this � � 5. � O <br />�" day of �'�`�r� 2010 by and between Nebraska Ecanamic Development Corporation <br />(NE�C�), with its principa�race of business located at 1fi1q Soutii 70 Street, �uite 201, Lincoln, N� <br />68506 (hereinafter NEDCO), and Growth Management Corporation-Nebraska with a business location at <br />_ �-�D�b S � _���"` G� � (����-- <br />- ,_ l�i r`1 � � � �� <br />PREMISES <br />WHEREAS Kershner Properties, with its principal place of business located at 2325 North Webb <br />Rd, Grand Island, Nebraska (her�inafter the "Borrower"), is the owner, in fee, of the following described <br />real estate: <br />2� Amended L�t Four (4), Block Nine (9), Continental Gardens, an Addition to the City of <br />Grand Island, Hall County, Nebraska <br />(hereinafter the "Property"); <br />WHEREAS the Borrower obtained financing, evidenced by a promissory note signed by <br />Borrower, as Maker, from Growth Management Corporatian-Nebraska (hereinafter the "Growth <br />Management Loan"). The Growth Management Loan is secured by, amnng o#her instruments, a D�ed of <br />Trust, filed against the Property, dated March 30, 2010 and recorded in the Wall County Register of <br />Deeds as Instrument No. 201002099 (hereinafter the "Growth Management Deed of Trust"); <br />WHEREAS, the Borrower has requested that NEDCO loan the Borrower a sum of mpney in the <br />amount of �203,000.00 (hereinafter the "504 Loan"). The 504 Loan will, as a condition of such loan, be <br />secured by a Deed of Trust to be filed in th� Hall County Register of �eeds against the Property; and <br />WHEREAS the 5Q4 Loan is to be made by NEDCO to the Borrower for the mutual benefit of <br />Growth Managem�nt Corporation-Nebraska and Borrower. <br />1 <br />
