<br />THAT WHEREAS, Under the Nebraska Trust Deeds Act, Neb. Rev. Stat. §§ 76-1001.
<br />to 76-1018 (Reissue 2009), a 17eed of Trust was executed by Shafer Properties, 1.LC, to the
<br />Geneva State Bank, Trustee, for the benefit of the Geneva State Bank, the bene�ciary
<br />named therein, December 11, 2003 and �led For recard on December 18, 2003 as
<br />Instrument #200316179 in the recnrda of the Register of Deeds in and for Hall County,
<br />Nebraska.
<br />WI-IEREAS, Trustee filed for record in the oFtice of thc Register of Deeds of the
<br />county wherein the property was situated, a Notice af Default, identifying the Trust Decd
<br />hy stating the name of the Trustor named therein and giving the book and page numbers
<br />where the saxne was recorded, a description of the Trust property, and said Notice
<br />containzng a statement that a breach of an obligation for which the Trust property was
<br />conveyed as security had occurred, and setting forth the nature of such breach and of the
<br />Truatee's election ko sell or cause to be sold such property to satisfy thc obligation; and
<br />WHEREAS, after the lapse of nat less khan ane month, the breach or default was
<br />not cured as required by law; and
<br />WH�REAS, the Trustee gave written notice of the time and place of sale
<br />particulaz describing the property to be sold by publication oF said notice, at least five
<br />(5) times, once a week for five (5) consecutive wecks, the last publication being at least ten
<br />(10) days but not more than thirty (3p) days prior to the sale, in a newspaper having
<br />general circulation in the county in which the property was to be sold or some part
<br />thereof was situated, all according to the Nebraska Trust Deeds Act; and
<br />WHEREAS, the sale was held at the time and place designated in the Notice of Sale
<br />which was between the hours of 9:00 a.m, and 5:00 p.m., and was at the courthause af
<br />the county in which the property to be sold or some part thereof was situated; and
<br />WHEREAS, the Notice of Sale was in substantially the form as pravided by the
<br />Nebraska Trust Deeds Act; and
<br />WHEREAS, on the date and at the time and place designated in the Notice of Sale,
<br />the Trustee sold the property at public auction Co Geneva State Bank which was the
<br />highest bidder, for the sum af One Hundred Three Thousand Dollars and No Cents
<br />($103,000.00); and
<br />and
<br />WHEREAS, the sale was conducted according to the Nebraska Trust Deeds Act;
<br />WH�REAS, the Notice of C7efault and the Notice of Sale were duly mailed by
<br />registered or certified mail with postage prepaid, to all persnns who had requested notice
<br />according to law, pr according to the L7eed of Trust, referenced herein; and
<br />WH�12�AS, the Trustee has complied with all of the provisions of the Nebraska
<br />Trust Deeds Act,
<br />NQW, THEREFOR�, I, as Trustee under the �.7eed of Trust herein referenccd, as
<br />afpresaid, in consideration of the premises and by virtue of the powers vested in me by
<br />law and by the herein referenced 17eed af Trust, do hereby give, grant and convey to said
<br />Geneva State Bank the premises so as aforesaid sold, ta-wit:
