<br />THAT WHEREAS, Under the Nebraska Trust Deeds Act, N. ev tat. §§ 76-1001
<br />to 76-1018 (Reissue 2009), a Construction 17eed of Trust was executed by Joel B. Shafer
<br />and Marcey A. Shafer, husband and wife, tp the Geneva State Bank, Trustee, for the
<br />benefit of th� Geneva State Bank, the bene�ciary named therein, I7ecember 21, 2Q05 and
<br />filed For record on December 23, 2005 as Instrument #200512548 in the records of Che
<br />Register of Deeds in and for Hall County, Nebraska.
<br />WI-I�REAS, Trustee filed for record in the office of the Register of Deeds af the
<br />county wherein the property was situated, a Notice of Default, identifying the Trust Deed
<br />by stating the name of the 1'rustor named therein and giving the book and page numbers
<br />where the same was recarded, a description af the Trust property, and said Notice
<br />containing a statement that a breach of an obligation for which the Trust property was
<br />conveyed as security had occurred, and setting forth the nature of such breach and of the
<br />Trustee's election to sell or cause to bc sald such property to satisfy the obligation; and
<br />Wk3ER�AS, afYer the lapse of not less than one month, th� breach or defaulC was
<br />not cured as required by law; and
<br />WHEREAS, the Trustee gave written notice of the time and place of sale
<br />particularly describing the property to be sold by publication of said notice, at least Five
<br />(5) times, once a weck for five (5) consecutive weeks, the last publication being aC least ten
<br />(10) days but not more than thirty (30) days prior to the sale, in a newspaper having
<br />general circulatian in the county in which the property was to be sold ar some part
<br />thereof was situated, all according to the Nebraska Trust Deeds Act; and
<br />W�-I�R�AS, thc sale was held at the time and place designated in the Notice of Sale
<br />which was between the hours of 9:00 a.m. and 5:00 p.m„ and was at Che courthouse of
<br />the caunty in which the property to be sold or some part thereof was situated; and
<br />WHEREAS, the Notice of Sale was in substantially the form as pravided by the
<br />Nebraska Trust Deeds Act; and
<br />WT3EREAS, on the date and at the time and place designated in the Notice of Sale,
<br />thc Trustee sold the property at public auction to Geneva State Bank which was Che
<br />highest bidder, for the sum of 'I�,vo Hundred Ninety-Nine Thausand 'I�vn Hundred Fifty
<br />I�ollars and No Cents ($299,250.00); and
<br />and
<br />WHEREAS, the sale was conducted according ta the Nebraska Trust 17eeds Act;
<br />WI�EREAS, the NoCice of Default and the Nqtice of Sale were duly mailed by
<br />registered or certified ma.il with postage prepaid, to all persons who had requested notice
<br />accprding to law, or accarding to the Deed of Trust, referenced her�in; and
<br />WHEREAS, Che Trustee has complied with all of the provisians pf the Nebraska
<br />Trust Deeds Act.
<br />NOW, TI-T�1�EFORE, I, as Trustee under the Deed of TrusC herein referenced, as
<br />aforesaid, in consideration of the premises and by virtue of the powers vested in me by
<br />law and by the herein reFerenced Deed of Trust, do hereby give, grant and convcy to said
<br />Geneva State Bank the premises so as aforesaid sold, to-wit:
