<br />Items." At originaHon or at any tlme during the term af the L.oan, Lender may require that Community
<br />Assodaflon Dues, Fees, and Assessments, if any, be escrowed by Borrower, and such dues, fees and
<br />assessments sball be an Escrow Item. Borrower shall promptly furnish to Lender all natices of anuounts to
<br />be paid under this 5ection. Barrower shall pay Lender the Funds far Escraw Items unless I.ender waives
<br />Borrowex's abligition to pay the Funds for any or all Escrow Items. Lender may waive Borrawer's
<br />nbligatlon to pay to Lender Funds for any or all Escrow Items at a�ry Wne. Any such waiver may anly be
<br />in writIng. In the event of such waiver. Borrower shall pay directly, when and where payable, We amounts
<br />due far any Escrow Items for wbich payment uf Funds has been waived by Lender and, if Lender requires,
<br />shall furnish to Lender receipts evidencing such payment within such lime penlod as Lender may require.
<br />Sorrower's obli�atlon to make such payments and to provide receipts shall for all purpases 6e deemed to
<br />6e a covenant and agreement contained in this Secw9ty Inswment. as the phrase "covenant and a�eement"
<br />is used in Sedion 9. I£ Barrower is obligated ta pay Fscrnw Items directly, pursuant to a waiver, and
<br />Barrower fails to pay We amount due for an Escrow Item, Lemder may exercise its nights under 5ection 9
<br />and pay such amount and Borrower shall then be obli$ated under Section 9 to repay w Lender any such
<br />amount. Lender may revoke the waiver as to any or all Escraw Items at any time by a notice given in
<br />accordance with 5er.tion 15 and. upon such revocaflon, Borcower s6a1! pay to I.ender all Funds, and in
<br />such aznounts, tLat are then required under this Section 3.
<br />Lender may, at any tlnue, collect and hald Funds in an amount (a) sufficient to permit Lender to �pply
<br />the Funds at the time speciiied under RESPA, and (b) not to exceed the ma�dmum amonnt a lender can
<br />rcqu�re uader R�SPA. J.e�ader shall estimate the amount of Funds due oa the bas�s af curcent data and
<br />reasonable esWnates af expenditures of fature Escrow Items or othervvise in accardance wiW Applicable
<br />Law.
<br />The Funds shall be held 1n aTl IILSI�L'11HD11 whose deposits are lnsured by a federal agenty,
<br />inxWmencality, nr entity (lncluding Lender, :if Lender is an lnstitutlon whose depos[ts are so insured) or in
<br />any Federal Home Loan Banlc. Lender xhall apply We Funds to pay the Escrow Items no later than the tlnne
<br />specifled under RESPA. Lender shall not cb,arga Borrower far holding and applyiug the Fands, annually
<br />analyz#ng We escrow account, or ver�'y9ng the Escraw Items, unles� Lender pays Borrower I�nterest on the
<br />Funds and Applicable Law permits Lender to make such a charge. Unless an agreement fs made in wrlting
<br />or Applicable I,aw requiras ir►terest to be paid on the Funds, Lender shall not be required to pay Borrower
<br />any intecest or earning�s on the Funds. Borrower and Lender can agree in wrldng, hawever, that interest
<br />shall be paid on the Funds. Lender shall glve tn Borrower, without charge. aa annual accounting of the
<br />Funds es required by RESPA.
<br />If there is a surplus a� Funds held in escrow. as defined uader RESPA, Lender shall account to
<br />Borrnwer for the excess funds in accordance wi�W RESPA. If there is a shortage of Funds held in escraw,
<br />�s deflned under R�SPA, Lender shall nntify Borrower as required by RE5PA, and Borrower shall pay to
<br />Lender We amount necessary to make up the shortage in accardance with RESPA, but in na more than 12
<br />monthly payment,s. If there is a deftdency uf Funds held in escrow, as deflned under RFSPA, Lender shall
<br />noHfy Borrower as rcquired by RESPA, and Borrower shall pay to Lender the amount �ecessary to make
<br />up the de8ciency in accordamce wifh RFSPA, but in no more than 12 monthly payments.
<br />Upon pa.yment in full of all sums secured by this Secvrlry Instrument, L.ender shall promptly retund
<br />to ;Borrower any Funds held by L.ender.
<br />4. Chargea; Lims. Borrower shall pay all taxes. assessments. charges, flnes� end imposldons
<br />attributable to the Prc►perty which can attain priority over thls Security Lutrument, leasehold paymcnis or
<br />ground rents an the Pmperty, if any, and Com�nunity Assodation� Dues. Fees� and As.�essments, if any. To
<br />the extent that th�.ce items are Escrow Items, Borrower shall pdy �them in the �manner provlded in 5ection 3.
