2oioos2si <br />lb. Governing Law; Severability; Rules of Construction. This Security Instrument shall be �overned bv federal la�v and <br />the law of the jurisdiction in which the Property is located. All rights and obligations contained in this Security Instrument are <br />subject to any requirements and limitations of Applicable Law. Applicable Lawmight explicitly or implicit]y allowthe parties to <br />agree by contract or it might bc silent, but such silence shall not be construed as a prohibition against agreemcnt by conlxact. <br />In the event that any provision or clause of this Security Instrument or the Note conflicts with Applicable Law, such conflict <br />shall not affect other provisions of this Security Instnzment or the Note which can be given efFect without the conflicting <br />provisian. <br />As used in this Security Instrument: (a) words of the masculina gender shall mean and include corresponding neuter <br />words or words of the feminine gender; (b) wnrds in the singular sha11 meui uid include lhe plural urd vice versa; and (c) the <br />word "may" gives sole discretion without any obligation to take any action. <br />l7. &�rrower's Copy. Borrower shall be given one copy of the Note a.r�d of this Sect�rity In.strun�ent. <br />18. Transfer of the Property or a Beneficial Interest in Borrower. As used inthis Section IS, "Interest inthe Prop�rty" <br />means any legal or beneficial interest in the Propetty, including, but not limited to, those beneficial interests transferred in a <br />bond for deed, cpntract. for deed, installmez�t sales contract ar escrow agreement, the intent of which is tlae transfer of title by <br />Borrowcr at a futuz'e datc to a purchascr. <br />If all or any parl of tlie Properly or any Interest ui 11►e Properly is sold or iransferred (or if Borrower is not a ualural person <br />and a beneficial interest in Borrower is sold or transferred) without Lender's prior written consent, Lender may require <br />immediate payment in full of a11 sums secured by this Security lnstrument. Hotvever, this option shall not be exercised by <br />Lender if such exexcise is prohibited by Applicable Law. <br />If Lender exercises this option, Lender shall give Borrower notice of accelcration. The notice sha11 provide a period of not <br />less than 30 days from the date the notice is given in accordance with Secdon 15 within which Borrower must pay all sums <br />secured by this Security Instlwnent. If Borrower fails to pay these sums prior to the expiration oF this periad, Lender may <br />invoke any remcdics permitted by this Security Instrument without further notice or dcmand on Borrower. <br />19. Bormwer's Right to Reinstate After Acceleration. if Borrower meets certain conditions, Borrower shall have tl?e <br />right to have enforccmcnt of tlxis Security Instrument discontinued at any Urne prior to thc carlicst of: (a) five days before salc <br />of the Property pursuant to any power of sale contained in this Secucity Instrument; (b) such other period as Applicable Law <br />might specify for the termination of Borrower's right to reinstate; or (c) entry of a jud�nent enforcing this Security Instrument. <br />Those conditions are tl�at Borrower: (a) pays Lender all sums whicl7 ihen would be due imder tl�is Securily I�istnmient and the <br />Note as if no acceleration had occurred; (b) cures any default of any other covenants or agreements; (c) pays all expenses <br />incurred in enforcing this Security Jnstrument, includang, but not limited to, reasonable attorneys' fees, property inspection <br />and valuation fees, and other fees incurred for tite piu'pose of protecting Lender's interest in the Properiy and righCs under this <br />Sectuity Instrtunenl; a.nd (d) takes such action as Lei�der iriay reasonably reqriire to aysure fliat Lender's i��lerest in the <br />Property and rights under this Securiry Instrument, and Borrower's obligation to pay the stuns secured by this Security <br />lnstrument, shall continue unchanged. Lender may require that Borrower p�y such reinstatement surns and expenses in one or <br />more of the following forms, as selected by Lender; (a) cash; (b) money order; (c) certified check, bank check, treasurer's check <br />or cashier's dieck, provided any such cl is drawn upon. an inscicution whose deposits are insured by a federal agency, <br />instrumentality or entity; or (d) Electronic Funds Transfer. Upon reinstatement by Borrower, this Security Instrument and <br />obligations secured hereby shall remain fully effective as if z►o acceleration had occurred. However, this right to reinstate shall <br />not apply in thc case of acceleration under Section 18. <br />20. Sale of Note; Change of I,9an Servicer; Notice of Grievance. The Note or a partial interest in the Note (together with <br />this Security Instrument) can be sold one or more tunes without prior notice to Borrower. A sale might result in a change in the <br />entity (known as the "Loan Servicer") that collects Periodic Payments due under the Note and this Security Instrurnent and <br />perfnniis olher morigage loan servicing obligafions nnder the Note, this Security Insh and Applicable Law. There also <br />might be one or more changes of the Loan Servicer unrelated to a sale of the Note. If there is a change of ihe Loan Servicer, <br />Borrower will be given written notice of the change which will state the name and address of the new Loan 5ervicer, the <br />address to which payments should be made and �ny other information RESPA requires in connection with a notice of transfer <br />nf scrvicing.
