<br />Beneficiary. The word "Beneficiary" means Platte Valley 5tate Bank & Trust Company, and its successors and assigns.
<br />Borrower. The word "Borrawer" means Michael 7. Leaman and Raliss E. Leaman and includes all co-signers and co-makers signing
<br />the Note and all their successors and assigns.
<br />Ueed of 1'rust. the words "Deed of TrusY' mean this Deed of Trust among Trustor, Lender, and Trustee, and includes without
<br />limitation ali essignment and security interest provisions relating to the Personal F'roperty and Rants.
<br />Default. The ward "Default" means the Default set forth in this �eed of Trust in the section titled "Defeult".
<br />Envirenmental Lews. The words "Environmental Laws" mean any and all state, federsl and Iocal statutes, regulations and ordinances
<br />relating to the protection of human health or the environment, including withnut limitation the Comprehensive Envirpnmental
<br />Response, Compensation, and Lisbility Act nf 1980, as amended, 42 U.S.C. Section 9601, et seq. ("CERCLA"�, the Superfund
<br />Amendments and Raeuthorizetion Act of 1986, Pub. L. No. 99-499 ("SARA"), the Hazardous Materials Transportation Act, 49 U.5.C.
<br />Section 1$01, et seq., the Resource Conservation and Recovery Act, 42 U.S.C. 5ection 69b1, et seq., or other applicable state nr
<br />federal laws, rules, or regulations adopted purauant thereto.
<br />Event of Default. The words "Event af Default" mean any of the events of default set forth in this Deed of Trust in the events of
<br />default section of this Deed of Trust.
<br />Guaranty. 7he word "Guaranty" means the gueranty frpm guarantor, endorser, surety, or accommodation party to Lender, including
<br />without limi#ation � guaranty af sll or part of the Note.
<br />Wazardous Substances. The words "Hazardous Subatances" mean materials that, because of their quentity, concentration or
<br />physical, Chemical or infeCtious characteristics, may cause or pose a present or potential hazard to human health or the environment
<br />when improperly used, treated, stored, disposed of, generated, manufactured, trensported or otherwise handled. 7he words
<br />"Hazardous 5ubstences" are used in their very broadest sense and include withput limitation any and all hazardous or toxic
<br />substances, materials or waste as defined by or listed under the Environmental Laws. The term "Hazardous Substances" also
<br />includes, without limitation, petroleum and petroleum by-products or any fraction thereof and asbestos.
<br />Improvements. The word "Improvements" means all existing and future improvements, buildings, structures, mobila hom�s affixed on
<br />the Fteal Property, facilities, sdditions, replacements end other construction on the Real Property.
<br />Indebtedness. The word "Indebtedness" mesns all principal, interest, and other amaunts, costs and expenses peyeble under the Note
<br />or Helated bocuments, together with all rsnewals of, extensions of, modifications of, consolidations af and substitutions fnr the Note
<br />or Rslated Documents and any amounts expended or advanced by Lender to discharge Trus#or's obligations or expenses incurred by
<br />Trustea ar Lender to enforce Trustor's obligations under this Deed of Trust, togethsr with interest on such amounts as provided in this
<br />❑eed of Trust.
<br />Lender. The word "Lender" means Platte Valley 5tate Bank & Trust Company, its successors and assigns.
<br />Note. The word "Npte" means the promissory note dated October 29, 2010, 117 the OI'Iglflal principal amount pf
<br />5294 ,000.00 from Trustor to Lender, together with all renewals of, extensions of, modifications of, refinancings of, consolidations
<br />of, and substitutions for the promissory nnte ar agreement.
<br />Personal Property. The words "Personal Property" mean sll equipment, fixtures, and other articles of personal property now or
<br />hereafter owned by 1"rustor, and now or hereafter attached or affixed to the Fteat Property; together with all eccessions, parts, and
<br />additions to, all replacements af, and all substitutions for, any of such property; �nd together with all proceeds (including without
<br />limitatian all insurance proceeds and refunds of premiums) from any sala or other disposition of the Property.
<br />Property. The word "Property" means collectively the Real Property and the Personal Proper#y.
<br />Real Property. The words "Real Property" mean the real property, interests and rights, es further described in this Deed of Trust.
<br />Ftelated Documents. 1"he words "Related Documents" mean all promissory notes, credit agreemsnts, loan agreements, environmental
<br />egreements, guarenties, security agreements, mortgages, deeds of trust, securi#y deeds, collateral mortgages, and all other
<br />instruments, agreements and documents, whether now or hereafter existing, executed in connection with the Indebtedness.
<br />Rents. The ward "Rents" means all present and future rents, revenues, income, issues, rayalties, profits, and ather benefits derived
<br />from the F'roperty.
<br />Trustee. The word "Trustee" means F'latte Valley State Bank & Trust Company, whose address is 810 Allen Dr, Grand Island, NE
<br />8$803 and any substitute or successor trustees.
<br />Trustor. The word "Trustor" means Michael T. Leaman end Ralisa E. Leaman.
<br />EACH TRUSTOR ACKNOWLEDGES HAVING R�AD ALL 1"H� PRpVISIONS OF THIS DEED OF TRUSt, ANq EACH TRUSTOR AGREES TO
