20�oo�99s <br />ARTICLE V <br />Miscellaneous <br />Section 5.1. Scope of Mort�a�e. This Mortgage is a deed of trust and mortgage of both <br />real/immovable and personal/movable property, a security agreement, a financing statement and <br />an assignment, and also covers praceeds and £'ixtures and all rights as s�t out herein. <br />Section 5.2. Ef.fective as a Financin� Statement. This Mortgage cavers goods which are <br />or are to become fixtures related to the real/immovable praperty described herein, and this <br />Mortgage shall be effective as a financing statement filed as a fixture fling (within the meaning <br />of the applicable UCC) with respect to all goods which are or are to become fixtures with respect <br />to the Mortgaged Frop�rties. This Mortgage is to be filed far record in the real/immovable <br />property records af each county (or the City of St. Louis Missouri as to the Deed of Trust <br />Mortgaged Properties located in the City of St. Louis, Missouri) where any part of the <br />Mortgaged Properties is situated and th� office of the Oklahoma Secretary af State, may also be <br />�led in the offices of the Bureau of Land Ma�agement, the General Land Office, or the Minerals <br />Management Service or any relevant federal or state agency (or aiay succ�ssar agencies). This <br />Mortgage shall also be effective as a�inancing statement covering any other Property which is ar <br />is to become fixtures and may be filed in any other appropriate filing or recording office, <br />including, but not limited to, the appropriate office(s) of any jurisdictaon in order to perfect the <br />secu�ity interests in the Property which is or is to become fixtures. The informatiar� provided in <br />this S�ction 5.2 is provided so that this Mortgage shall camply with the requirements of the UCC <br />for a mortgage instrument to be filed as a finazzcing statement. Mortgagor is the "Debtor" and its <br />name and mailing addz'ess are set forth on the signature page hereto. Administrative Agent is the <br />"Secured Party" and its name and mailing address from vvhich information concerning the <br />security interest granted her�in may be obtained are set forth set forth on the signature pag� to <br />this Mortgage. A statement describing th� portion of the Mortgaged Prop�rties comprising the <br />fixtures hereby secured is set forth in Section 1.1 and Sectian 1.2 of this Mortgage. Mortgagor <br />represents and warrants ta Administrative Agent that Mortgagor is the record owner of (or has a <br />leasehold interest in) the Mortg��ed Prop�rties, the employer identificatian number of Mortgagor <br />and the orgattizational identification nurnber of Mortgagor are set forth an the cover page (after <br />the recording cover sh�et, if any) hereto.
