201007997 <br />NON-UNIFORM COVENANTS. Borrower and Lender further covena�at and agree as follows: <br />22. Acceleratlnn; Remediea. Lender shall give notice to Borrawer prior to scceleration follawing <br />Borrower's breach of any covenant ar agreement in this Security Instrument (but not prlor to <br />acceleratlon under Sectlnn 18 unless Applicable Law provide� atherwise). The notice shall apedfy: (a) <br />the defaqlt; (b) the acbian required to cure the default; (c) a date, not leas than 30 day� from the date <br />the notice ie given to Barrower, by which the default must be cured; and (d) that failure to cnre the <br />default an or before the date �pecified in the notice naay result in acceleratlon of the sum� eecured by <br />thf� Security Instrument and aale of the Property. The aol3ce $hall further infor� Borrower of the <br />right to reinatate after acceleration and the right to bring s court action to as$@rt the non-eaiatence of <br />a default or any other defen�e of Borrower to acceleratlon and �ale. If the default is not cuced on or <br />before the date specified in the notice, Lender at ita aption may require immediate payment in full af <br />all sums secured by this Security Instrument withant further demand and may invoke the power of <br />sale and any other remediea permltted by Applicable Law. Lender shall be entitled to collect all <br />ezpenses incurred in pur�uing the remedies provided in this Section 22, including, but not limited to, <br />re�sonable attarney�' fees and costs oi title evidence. <br />If the power of �ale ia invoked, Tru�tee shall record a notice of default in each county in whicl� <br />any part of the Praperty is located and ffihall mail copies oi �uch notice in the manner pre�crlbed by <br />Applicable Law to Borrower and to the other person� prescribed by Applicable Law. After the time <br />required by Applicable Law, Trustee shall give pablic notice nf sale to the persan� and in the manner <br />prescriberl by Applicable Law. Trustee, without demand on Borrower, shall sell the Praperty at <br />public auctian to the highest bidder at the time and place and under the terms de�ignated in the <br />notice uf sale in ane or mare parcels and in any order Truatee determines. Trustee may paatpone sale <br />af all or any parcel of the Property by public announcement at the time and place of any previously <br />scheduled aale. Lender or its designe� may purchaae the Property at any sale. <br />Upon receipt of payment of the price b1d, Trustee shall deliver to the purchaser Trustee' � deed <br />conveying the Property, The recitalffi in the Trustee'� deed shall be prima facie evidence of the truth <br />of the statements made therein. Trustee shall apply the proceeda of the snle in the following order: (a) <br />to all costs and ezpenses of eaerdsing the power of sale, and the ffiale, including the payment of the <br />Trustee' e fees actually incurred and reasonable attarneys' fees as permitted by Applicable Law; (b) to <br />all aums �ecured by this Securlty Instrument; and (c) any e�cces� t� the person or per�ons legally <br />entltled to i� <br />23. Reconveyance. Upon payment of all sums secured by this Security Tnstrument, Lender shall <br />request Trustee to reconvey the Property and shall surrender this Security Instrument and all notes <br />evidencing debt secured by this Security Instrument to Trustee. Trustee shall reconrrey the Property <br />without warranty to the person or persons legally entitled to it. Swch p�rson or persons shall pay any <br />recordation costs. Lender rnay charge such person or persons a fee for raconveying the Property, but only <br />if the fee is paid to a third party (such as the Trustee) for secvices rendered and the charging of the fee is <br />pertnitted under Applicable Law. <br />24. Sub�titute Tru�tee. Lender, at its aption, may from time to time remove Trustce and appoint a <br />successor trustee to any Trustee appointed hereundear by an instrurx��nt recorded in the county in which this <br />Security Instrument is r0corded. Without conveyance of tlxe Pxoperty, the successor trustee shall succeed to <br />all tha title, power and duries canferred upon Trustee herein and by Applicable Law. <br />ZS. Request for Nof3ce�.
