Woitaszewski and Linda K. Woitaszewski, husband and wife ("Woitaszewski"). A. � C RECITAL3 Blender owns the following real estate: Lot Three (3), Blender Subdivisian, Hall County, Nebraska, referred to herein as the "Blender Property". Woitaszewski ou�s the following real estate: Lot 'Ibvo (2), Blender Subdivision, Hall County, Nebraska, referred t� herein as the "Woitaszewski Property". Woitaszewski has acquired the Woitaszewski Property fram Blender. Both Blender and Woitasze�rski desire ta acquire and to grant the access and utility easements as further described in this Easernent. NOW THEREFORE, in consideration of One and No/ 100 Dollars (�1.Q0), the receipt of which is hereby acknowledged, and ather valuable corisideration, Blender and Woitaszewski agree as follows: 1. Grant of Access Easement - Blender to Woitaszewski. Blender does hereby convey ta Waitaszewski, its respective successors and assigns, a nan-exclusive easement over the Blender Property for purpose of ingress and egress to the Woitaszewski Property, including but not limited to the purpose of turning serni- tractors, trailers, and other vehicles traveling on the Waitaszewski Property around. The parties agree that the easement area shall generally be limited to the north two hundred fifteen (215) feet of the eastern forty-fiv� (45) feet of the Blender Property, as well as the driveway area on the Blender Property providing access from Blender Road to the Blender Property and which driveway also provides access to the Woitaszewski Property. The right of ingress and egress shall be exercised in a reasonable manner, and shall not include any areas that contain a building or other cornrnercial structure. Woitaszewski's right to enter the easernent areas includes the right to maintain and repa.ir, at Woitaszewski's expense, any roadway or related irnprnvements in the easement areas if desired by Woitaszewski. 2. Grant af Access Easement - Woitaszewski to Blender. Woitaszewski does hereby convey to Blender, its respective successors and assigx�s, a non-exclusive eas�ment to enter the Woitas2ewski Property for purpose of ingress and egress to the Blender Property, including but not lirnited to the purpose of turning semi-tractors, trailers, and other vehicles traveling on the Blender Praperty axound. The parties agree tha� the easement area shall generally be limited to the west forty-five (45) feet of the northern one hundred (�.00) feet of the Woitaszewski Property. The right of ingress and egress shall be exercised in a reasonable rnanner, and shall nat include any areas that contain a building or other commercial structure. Blender's right to eriter the easement area includes the right to maintain and repair, at Blender's experise, any roadway or related ixnprovernents in the easement area if desired by Blender. � � �V { 1305729.3 }
