Woitaszewski, husband and wife ("Woitaszewski"). <br />A. <br />� <br />C <br />RECITAL3 <br />Blender owns the following real estate: <br />Lot Three (3), Blender Subdivisian, Hall County, Nebraska, <br />referred to herein as the "Blender Property". <br />Woitaszewski ou�s the following real estate: <br />Lot 'Ibvo (2), Blender Subdivision, Hall County, Nebraska, <br />referred t� herein as the "Woitaszewski Property". <br />Woitaszewski has acquired the Woitaszewski Property fram Blender. Both <br />Blender and Woitasze�rski desire ta acquire and to grant the access and utility <br />easements as further described in this Easernent. <br />NOW THEREFORE, in consideration of One and No/ 100 Dollars (�1.Q0), the <br />receipt of which is hereby acknowledged, and ather valuable corisideration, Blender <br />and Woitaszewski agree as follows: <br />1. Grant of Access Easement - Blender to Woitaszewski. Blender does <br />hereby convey ta Waitaszewski, its respective successors and assigns, a nan-exclusive <br />easement over the Blender Property for purpose of ingress and egress to the <br />Woitaszewski Property, including but not limited to the purpose of turning serni- <br />tractors, trailers, and other vehicles traveling on the Waitaszewski Property around. <br />The parties agree that the easement area shall generally be limited to the north <br />two hundred fifteen (215) feet of the eastern forty-fiv� (45) feet of the Blender <br />Property, as well as the driveway area on the Blender Property providing access <br />from Blender Road to the Blender Property and which driveway also provides <br />access to the Woitaszewski Property. The right of ingress and egress shall be <br />exercised in a reasonable manner, and shall not include any areas that contain a <br />building or other cornrnercial structure. Woitaszewski's right to enter the easernent <br />areas includes the right to maintain and repa.ir, at Woitaszewski's expense, any <br />roadway or related irnprnvements in the easement areas if desired by Woitaszewski. <br />2. Grant af Access Easement - Woitaszewski to Blender. Woitaszewski <br />does hereby convey to Blender, its respective successors and assigx�s, a non-exclusive <br />eas�ment to enter the Woitas2ewski Property for purpose of ingress and egress to the <br />Blender Property, including but not lirnited to the purpose of turning semi-tractors, <br />trailers, and other vehicles traveling on the Blender Praperty axound. The parties <br />agree tha� the easement area shall generally be limited to the west forty-five (45) <br />feet of the northern one hundred (�.00) feet of the Woitaszewski Property. The right <br />of ingress and egress shall be exercised in a reasonable rnanner, and shall nat include <br />any areas that contain a building or other commercial structure.
